MINUTES OF THE CITY COUNCIL REGULAR MEETING
FEBRUARY 14, 1gM5
The February 14, 1995, regular meeting of the City Council of the City of
Poway, was called to order at 7:00 p.m., by Mayor Higginson at the City Council
Chambers, 13325 Civic Center Drive, Poway, California.

PLEDGE OF ALLEGIANCE
Deputy Mayor Callery led the Pledge of Allegiance.
PUBLIC ORAL COMMUNICATIONS
Mayor Higginson explained the procedure for Public Oral Communications. The
following persons were present wishing to speak:
Kyle Everson, 13561 Comuna Drive, spoke regarding trash rates in
condominium areas and commercial areas. He said bids would have been
lower if they had accepted North County Resource and Recovery Services
offer and asked that the bidding process either be updated or re-opened.
Since Mr. Everson said he had not met with staff, Council suggested he
discuss his concerns with them first.
Fran Colling, 13340 Alpine Drive, spoke about the data being required as
a condition of the Resale Agreement in Poway Royal Mobile Estates and
protested the rent increase that will result if the data is not provided.
City Attorney Eckis stated Ms. Colling is one of the plaintiffs in a
lawsuit with the City and he will be glad to talk to her attorney about
this matter.

Sylvia Nicpon, 13325 Buena Vista, stated she will continue to "be in the
Council's face" each week until her concerns about Poway Royal are
resolved.
CONSENT CALENDAR
City Clerk Wahlsten stated an amendment to Item 6 had been distributed to the
City Council and approval of that Item will include that amendment.
Motion by Councilmember Callery, seconded by Councilmember Emery to approve the
Consent Calendar as follows:

Appropriation of $7,783 from the Capital Replacement Fund for the purchase

PUBLIC NOTICE FOR TENTATIVE MAP 94-02

VARIANCE 94-13/DEVELOPMENT REVIEW 94-07
APPLICANT: SHEA HOMES
Mayor Higginson noted this was continued from January 17, 1995 in order to
receive information on the notice that was given for the public hearing on
Tentative Tract Map 94-02 held June 21, 1994. Several speakers had appeared at
that meeting and stated they had not received notice. Staff report by City
Attorney Eckis. He stated the City fulfilled all legal obligations of notice.
If the City Council found that the notice was not sufficient it could vote to
reconsider the Tentative Map. However, there are no facts to conclude that
notice was not legally given. Staff recommends the City Council find that the
notice given was adequate and proceed with consideration of the Development
Review.

Barbara Diaz, 12820 Montauk, requested the City Council rehear the
Tentative Tract Map because notice was not received by 130
households.
Ronald Stampfl, 12734 Pomerado Road, stated he had voiced his concerns
regarding density, traffic, and child safety at the June
hearing.
Speaking in favor of staff recommendation:
Peter Radosevich, 12844 Montauk Street, stated the proposed project was
better than having very low-income housing there.

Motion by Councilmember Emery, seconded by Councilmember Cafagna to close the
public hearing. Motion carried unanimously.
Councilmember Emery stated he had voted against the project in June and would
again, however there are not 130 people saying they did not receive notice and
he has received calls from persons stating they did receive the notice so there
is no reason to rehear the Tentative Tract Map.
Motion by Councilmember Emery, seconded by Councilmember Callery to find that the
notice given for Tentative Tract Map 94-02 was not defective. Motion carried
unanimously.
Motion by Councilmember Emery, seconded by Councilmember Callery to find that the
previously certified final EIR for the seniors village project adequately
addresses the potential environmental impacts and adopt Planning Resolution No.
P-95-10, entitled, "A Resolution of the City Council of the City of Poway,
California Approving Development Review 94-07 and Variance 94-13, Assessor's
Parcel Number 312-211-02, 04." Motion carried unanimously.
ITEM 5 (1180-09)
POWAY TODAY PAPER STOCK COST
Staff report by City Manager Bowersox. On January 17, Councilmember Rexford
asked if a cheaper paper could be used to print Poway Today. Staff has selected
a 50 pound book stock rather than a 28 pound newsprint so that it doesn't look
like "junk" mail; the printed registration form can be used for recreation
classes; and the stock stands up well to repeated handling in the distribution
process. The price of the stock for 20,000 copies is $3,613 for the 50 pound
stock versus $2,210 for 28 pound.
Council concurred to receive and file this report.

Councilmember Rexford requested an article about dead animal pick-up in the next
issue.
ITEM 5.1 (1504-10)
POWAY SHERIFF SUBSTATION SITE REVIEW
Staff report by City Manager Bowersox. He reviewed drawings showing options of
facilities on the Western Lumber, Huber and Brookview sites with a combination
of the Library, Sheriff's facility and senior and/or family housing. He also
reviewed the financial implications of the CFebruary 17, 1995ity building the
Sheriff Station. The benefits include the Sheriff being in a new facility
designed as a Sheriff Station; the City would own the building and would lease
to the County; if the City ever decided to have its own police department it
would have a facility available; under the law enforcement contract, the cost
is averaged with all other Sheriff's facilities used by the contract law
enforcement cities.
Speaking to this issue:
Larry Cruse, 13734 Utopia, urged against co-mingling uses on the library
site.
Jerry Hargarten, 13622 Orchard Gate, stated that, based on staff's
analysis, having the City build the facility is beneficial.
He asked if we have a cost of construction and if the Council will
sign.some sort of agreement to lease before we start the design
work.
Council concurred the exact placement on the Western Lumber or Huber site should
wait until the February 16 workshop with the Library Advisory Committee and the
February 28 meeting with the Redevelopment and Housing Advisory Committee.
CITY HANAGER ITEHS
City Manager Bowersox stated that the County Board of Supervisors had approved
the claim settlement process for the residents on Springvale that was discussed
at the February 7, 1995 City Council meeting.
City Manager Bowersox congratulated Councilmember Cafagna and former
Councilmember Linda Oravec for being named among 35 San Diegans of the Year by
San Dieqo Home & Garden magazine.
mAYOR AND CITY COUNCIL-INITIATED ITEMS

Councilmember Rexford requested and the Council concurred that she be
allowed to make the appointment to fill the existing vacancy on the
Library Advisory Committee.

18A. Mayor Higginson and the Council confirmed Elaine Jeter as Chairperson of
the Senior Issues Committee. (701-09)

Mayor Higginson requested and received concurrence to hold a Pre-
Development Conference on February 21, 1995 to consider a request to build
a residence on property owned by the Catholic Diocese at the corner of
Tannin Drive and Solera Way, Paule Stern, applicant. (203-18)
18C.
Council concurred with Mayor Higginson's suggestion to set a joint meeting
with the Redevelopment and Housing Advisory Committee to discuss the
judgment order in the case of Smith v. All Persons for February 28, 1995.
ADJOURNMENT
Upon motion by Councilmember Cafagna, seconded by Councilmember Emery, Mayor
Higginson adjourned the meeting to 5:00 p.m., Thursday, February 16, 1995.
