RESOLUTION NO. P-04-56
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT 04-57
TO HOLD THE ANNUAL POWAY DAYS EVENTS
WHEREAS, Temporary Use Permit 04-57; City of Poway Community Services
Department and the Poway Chamber of Commerce, Applicants, requests approval to
hold the Annual Poway Days events from Wednesday, September 1, 2004, through
Thursday, September 30,2004.
WHEREAS, on August 17, 2004, the City Council considered the above-
referenced item.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway, as follows:
Section 1: The City Council finds that Temporary Use Permit 04-57 is Categorically
Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to
Section 15304(e) of the CEQA Guidelines, as the events are temporary in nature and
will have no effects on the environment.
Section 2: The proposed use is in accordance with the purposes and standards of
Section 17.26.030.A of the Poway Municipal Code.
Section 3: The City Council hereby approves Temporary Use Permit 04-57 for the
Annual Poway Days events that take place from Wednesday, September 1, 2004,
through Thursday, September 30, 2004, subject to the following conditions:
A. The events and related off-site parking shall be conducted as shown on the site
plans and application on file in the Development Services Department.
B. The Temporary Use Permit for the Kiwanis Club Kar Show, located at Valley
Elementary School, is not valid until the applicant provides authorization from the
Poway Unified School District for the use of Valley Elementary School.
C. This permit is valid during the hours of the scheduled events from Wednesday
September 1, 2004, through Thursday, September 30, 2004, after which time the
sites shall be restored to their original condition.
D. Approval of this activity shall not excuse compliance with all other sections of the
Zoning Ordinance and all other applicable State, County, and City Ordinances
presently in effect.

E. Prior to the events, unless other timing is indicated, the applicant shall comply
with the following:
1. The following City of Poway departments shall be contacted for
appropriate permits, coordination, and inspections: Public Works,
Community Services, Customer Services, Development Services
(including the Building, Traffic Engineering, and Planning Divisions),
Safety Services, and the Sheriff's Department.
2. An insurance bond indemnifying the City from possible liability in an
amount not less than $1 million for events that utilize City property shall be
provided to the Development Services Department, Planning Division, by
Friday, August 27,2004.
3. Any requests for Public Works support shall be made at least two weeks
prior to the scheduled events.
4. Signs shall be posted on Poway Road giving the particulars of dates and
times of closure one week prior to the Poway Days Heritage Parade. All
signage shall be in conformance with the temporary signage provisions of
the Poway Municipal Code. Contact the Development Services
Department, Planning Division, regarding the temporary Sign Ordinance
prior to the installation of any sign.
F. The applicant shall comply with the following to the satisfaction of the Fire
Marshal:
1. Prior to and during all events, emergency vehicle access to any street,
building, fire hydrant or fire sprinkler system connection shall not be
blocked.
2. Obtain a permit from the Fire Department for any canopy that exceeds 400
square feet.
3. Provide at least one (1) fire extinguisher with a minimum rating of 2A:10BC
at booths where cooking food is done.
4. Secure any compressed gas cylinders from falling over.
5. Obtain a permit from the Fire Department for the Barbecue.
G. During the Poway Days Heritage Parade, the Chamber of Commerce, as the
applicant, shall ensure that:

1. The westbound lanes of Poway Road shall be kept open for emergency
vehicles. Street intersections along the parade route shall be kept clear of
spectators for emergency traffic.
2. Barricades and cones shall be placed along the parade and detour routes.
H. During all Rodeo events, the Poway Valley Rider's Association (PVRA) shall
ensure that:
1. A temporary "NO PARKING, TOW-AWAY ZONE" shall be established on
the west side of Tierra Bonita Road, from Donart Drive north to Poway
Valley Road, to provide a wider pedestrian walking area into and out of the
PVRA grounds, and to ensure sufficient access for emergency vehicles -
fire, paramedic and law enforcement. The "NO PARKING" signs shall be
placed along this area approximately 250 feet on center.
2. In all unpaved parking areas, temporary markers shall be provided to
delineate parking areas and aisles, and to ensure that no parking occurs
within 100 feet of any existing residential structure.
3. A designated area for police, fire and paramedic units out of the main
activity areas and adjacent to the south vehicle gate of the PVRA property
shall be provided.
4. A copy of the agreement with the adjacent property owner(s) for parking
rights shall be provided to the Development Services Department,
Planning Division, prior to Friday, September 3, 2004.
5. The applicants shall ensure that the event is in compliance with Chapter
6.24 of the Poway Municipal Code regulating the treatment of rodeo
animals.
I. At the conclusion of all events, the applicants shall comply with the following:
1. Public streets, off-street parking sites, and areas within and adjoining the
proposed areas for the event shall be cleared of debris, litter, temporary
signs, and all other evidence of the event shall be removed upon its
completion.
Section 4: This approval shall become null and void on Friday, October 1, 2004, at
1 :00 a.m., at which time the sites utilized shall have been restored to their original
condition.

PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
State of California, at a regular meeting this 17th day of August 2004.
