RESOLUTION NO. 07-077
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
ORDERING THE SUMMARY VACATION OF THE
SOUTHERLY 128.70 FEET OF THAT PORTION OF SYCAMORE AVENUE
LYING NORTH OF THE NURSERY TRACT
AS SHOWN ON PIERMONT, MAP NO. 785
(VACATION 07-01)
WHEREAS, the City Council of the City of Poway desires to summarily vacate
the southerly 128.70 feet of that portion of Sycamore Avenue lying north of the Nursery
Tract as shown on Piermont, Map No. 785, in accordance with the procedures provided
in Part 3, commencing at Section 8300, of Division 9 of the State of California Streets
and Highways Code; and
WHEREAS, Sycamore Avenue was dedicated for public street purposes as
shown on the final map of Piermont, Map No. 785; and
WHEREAS, the development of Aubrey Park has caused a portion of Sycamore
Avenue to be considered as excess right-of-way and not required for street purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway, California, as follows:
1. This summary vacation is made under the provisions of Chapter 4, Part 3,
Division 9 of the Streets and Highways Code of the State of California.
2. The City Council hereby finds that the subject portion of Sycamore
Avenue is excess right-of-way and not required for street purposes
(Section 8334).
3. The City Council hereby declares that the southerly 128.70 feet of that
portion of Sycamore Avenue lying north of the Nursery Tract as shown on
Piermont, Map No. 785 is hereby vacated.
4. The City Clerk of the City of Poway is hereby directed to cause a certified
copy of this Resolution to be recorded in the office of the Recorder of San
Diego County in accordance with the provisions of Section 8336 of the
Street and Highways Code of the State of California.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
California, at a regular meeting this 16th day of October 2007. .
