ORDINANCE NO. 664
AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA,
APPROVING SPECIFIC PLAN AMENDMENT 84-01C(4)
TO THE SOUTH POWAY SPECIFIC PLAN
TO CHANGE THE LAND USE DESIGNATION
ON A 1.1-ACRE, DEVELOPED PROPERTY
LOCATED AT 12925 BROOKPRINTER PLACE
FROM LIGHT INDUSTRIAL TO INDUSTRIAL PARK

WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning
Development Code) of the Poway Municipal Code provides the requirements for the
initiation, preparation, and adoption of Specific Plans in accordance with Section 65450,
et seq. of the California Government Code (Article 8, Specific Plan); and
WHEREAS, Section 17.47.020.C (Initiation) of the Zoning Development Code
provides that the City Council may initiate the preparation of, or amendment to, a
Specific Plan on property by Resolution; and
WHEREAS, on October 16, 2007, the City Council initiated Specific Plan
Amendment 84-01A(4) by Resolution; and
WHEREAS, Specific Plan Amendment 84-01C(4) is proposed to change the
Land Use Designation on a 1.1-acre, developed property located at 12925 Brookprinter
Place from Light Industrial to Industrial Park; and
WHEREAS, on November 6, 2007, the City Council held a duly advertised public
hearing to solicit comments from the public, both pro and con, relative to this
application.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
ORDAIN AS FOLLOWS:
Section 1: The City Council finds that a Negative Declaration was issued in
conjunction with SPA 84-01QQ on July 17, 2001, which evaluated the conversion of
Light Industrial properties to the Industrial Park designation and that the proposed
project is within the scope of the prior environmental document; therefore, no additional
environmental review was conducted.
Section 2: The City Council hereby approves Specific Plan Amendment 84-01C(4)
changing the Land Use Designation from Light Industrial to Industrial Park on the
1.1-acre property shown in Exhibit A, attached to this Ordinance, subject to the following
conditions of approval:

1. The applicant shall pay a land use conversion traffic impact fee, in the amount of
$4,296, to the City prior to the effective date of this Ordinance.
2. Within 90 days of the effective date of this Ordinance, a Deed Covenant in a
form, and with language to the satisfaction of the City Attorney, shall be recorded
on the properties located at 12925 Brookprinter Place (APN 317-224-22) and
12875 Brookprinter Place (APN 317-224-22). The Deed Covenant shall stipulate
that uses on the property located at 12925 Brookprinter shall be limited to those
uses identified in the Light Industrial Land Use Designation of the South Poway
Specific Plan (SPSP) until such time parking that complies with the Industrial
Park Land Use Designation requirements of the SPSP, is provided to the
satisfaction of the Director of Development Services.
3. Prior to the building located at 12925 Brookprinter Place being occupied by an
Industrial Park use, additional parking shall be provided in accordance with the
Industrial Park Land Use Designation requirements specified in the South Poway
Specific Plan. Parking may be provided on the subject site, and on the adjacent
sites that are party to an existing shared parking agreement with the subject site.
Prior to adding the parking, the applicant shall submit an application, plans, and
fees to the Planning Division for processing and approval of a Development
Review (DR) application for these site improvements. Additional parking lot
landscapinQ may be required as part the DR review and approval.
Section 3: This Ordinance shall be codified.
EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30)
days after the date of this passage; and before the expiration of fifteen (15) days after
its passage, it shall be published once with the names and members voting for and
against the same in the Poway News Chieftain, a newspaper of general circulation
published in the City of Poway.
Introduced and first read at a regular meeting of the City Council of the City
of Poway held this 6th day of November 2007, and thereafter PASSED AND ADOPTED
at a regular meeting of said City Council held the 27th day of November 2007.
