CC 1996 05-16 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL ADJOURNED REGULAR MEETING MAY 16, lgg6 The May 16, 1996, meeting, adjourned from the May 14, 1996 regular meeting of the City Council of the City of Poway, was called to order at 5:12 p.m., by Councilmember Emery at the City Council Chambers, 13325 Civic Center Drive, Poway, California. COUNCILMEMBERS PRESENT AT ROLL CALL Susan Callery, Bob Emery, Betty Rexford COUNCILMEMBERS ABSENT AT ROLL CALL Mickey Cafagna (Councilmember Cafagna arrived at 5:14 p.m.) Don Higginson STAFF MEMBERS PRESENT James Bowersox Marjorie Wahlsten Steve Eckis Mark Weston City Manager City Clerk City Attorney Director of Engineering Services PUBLIC ORAL COMMUNICATIONS Councilmember Emery explained the procedure for Public Oral Communications. There was no one present wishing to speak. (Deputy Mayor Cafagna arrived and assumed the chairmanship of the meeting.) Deputy Mayor Cafagna stated that Jeff Mangum had called and he will be late. Council agreed to take Item 4 first. ITEM 4 (1202-02) ELECTRIC INDUSTRY RESTRUCTURING Carol Dorman, San Diego Gas & Electric Governmental Affairs Representative, stated the Public Utilities Commission, in December, 1995, decided to create a competitive marketplace for electricity, called restructuring. The overall goal is to reduce rates, which will be an aid to economic development in the State. Terry Winter, SDG&E Director of Power Operations explained the power exchange process. Gary Cotton, Senior Vice President of Customer Operations talked about ENOVA, the new structure for their utility. 5811 Page 2 - CITY OF POWAY - May 16, 1996 ITEM 3 (1204-01) WATER IN OLD COACH ROAD AREA Staff report by City Manager Bowersox. After hearing a presentation by Old Coach area residents on March 12, 1996, City Council directed staff to meet with the residents to discuss options for providing City water and help facilitate a solution to the problem. The ground water levels in the area have dropped abruptly since summer of 1995. On April 17, 1996, City staff met with residents from the Old Coach area and presented a cost estimate for providing City water to approximately 20 homes. The cost was estimated to be $40,00 per home. The majority of the property owners preferred to resolve the problem by evaluating the cause of the problem. They believe it may be due to the new wells that have been installed and lakes that have been filled on Hidden Valley Ranch. The homeowners would like to work with the owners of Hidden Valley Ranch to evaluate the problem. City Attorney Eckis noted that the City does not have the power to adjudicate privately held water rights. We can try to facilitate a discussion of the problem and a solution. There is also a limit on what we can spend public money on. Costs of improvements must be borne by those who benefit. Director of Engineering Services Weston stated there is a problem. Water levels in the wells are dropping. Old Coach Golf Estates will build a public water line when they develop and realign Old Coach Road which will bring water closer to these properties, but there is no time table for the construction. Jeff Mangum, 18111 Old Coach Road, stated they have spent thousands of dollars on their wells and are not willing to give that up. He stated they want their water back and want the City to mediate and provide either a legislative solution or a judicial solution. Ed Malone, 17150 Old Coach Road, owner of Hidden Valley Ranch, stated he had spent hundred of thousands of dollars on water studies and suggested the other homeowners do their own studies. Council encouraged the residents to hire a hydro geologist to gather data on their water sources.
