Res 07-087 RESOLUTION NO. 07-087 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA ADOPTING A MASTER SCHEDULE OF FEES WHEREAS, the City Council of the City of Poway has the authority to establish fees for City services; and WHEREAS, the City Council finds it necessary to recover the costs for City services; and WHEREAS, the City completed an Overhead Cost Allocation Study and resulting Cost Allocation Plan, that was accepted by the City Council on May 15, 2007; and WHEREAS, the Overhead Cost Allocation Plan identified a General City Overhead Rate and allows for cost recovery to the General Fund, paid from other funds; and WHEREAS, a comprehensive review of the City's fees was subsequently undertaken, resulting in the determination of associated costs; and WHEREAS, the City's fee study revealed that many of the City's fees are not adequate to fully recover the City's costs of providing the services; and WHEREAS, the City Council, in consideration of this review, has established various cost recovery levels for City services; and WHEREAS, an updated fee schedule has been developed which is consistent with the City Council's direction regarding cost recovery, which is set forth in the attached Table 1 (General Fees) and Table 2 (Development Fees); and WHEREAS, the proposed fees do not exceed the reasonable costs of providing the services for which the fees are imposed; and WHEREAS, the proposed fees will supersede any previously established fee for specified City services; and WHEREAS, the adopted fees will be evaluated each year to ensure consistency with Council's direction regarding cost recovery; and WHEREAS, a duly noticed public hearing has been held, allowing for public comment on the establishment of said fees. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Poway as follows: Resolution No.07 -087 Page 2 Section 1. The foregoing recitals are true and correct, and the City Council so finds and determines. Section 2. The City Council hereby adopts the Overhead Cost Allocation Plan and User Fee Study. Section3. That the fees shown in the attached Table 1 are hereby adopted and supersede any previously established fee for the identified City service. Section 4. That the fees shown in the attached Table 2 are hereby adopted and supersede any previously established fee for the identified City service. Section 5. The fees shown in Table 1 shall become effective on January 1, 2008, and the fees shown in Table 2 shall become effective February 11,2008.
