ACKNOWLEDGMENT WITH RESPECT
TO LIMITATION ON WATER SERVICE
STONERIDGE UNIT NO. 1 Io-ZS- 7("
MEDALIST CORPORATION, as owner of the lands with the boundaries
of POWAY MUNICIPAL WATER DISTRICT, San Diego County, California,
described in Exhibits IlAIl and liB" attached hereto, Lots 2 and 3
respectively of Stoneridge Unit No. 1, is in the process of filing
a final subdivision map presently known as Revised Tentative Map No.
3064. MEDALIST CORPORATION has requested DISTRICT to approve water
systems to serve said lots, even though at this time, ( 1) with
respect to Lot 3 (Exhibit "B") DISTRICT has not made a commitment to
furnish water and (2) with respect to Lot 2 (Exhibit "An) MEDALIST
CORPORATION has not yet furnished DISTRICT an agreement relating to
other lands which is a condition of DISTRICT's commitment. POWAY
MUNICI-PAL WATER DISTRICT is unwilling to approve the waterworks
system for the lands described in Exhibits IIAIF and "B" unless an
acknowledgment that DISTRICT is not presently obligated to furnish
water is filed for record with the office of the County Recorder of
San Diego County prior to its approval.
In order to induce POWAY MUNICIPAL WATER DISTRICT to presently
approve a waterworks system for the lands described in Exhibits "A"
and "BII MEDALIST CORPORATION does hereby acknowledge for itself and
its successors and assigns, its understanding and agreement that:
(1) With respect to Lot 3 (Exhibit "B"), DISTRICT has not
made a commitment to furnish any water to any portion thereof and will
not do so nor be obligated to furnish any water until:
(a) Completion of an analysis by DISTRICT's engineers
of DISTRICT's Improvement District No. 4 water system and necessary

additions thereto, including offsite lines, to serve said Lot and
other lands within said Improvement District. Said analysis will be
made by DISTRICT when it receives the sum of $3,000.00 from MEDALIST
CORPORATION as its agreed contribution to the cost of the analysis;
(b) Satisfactory provisions have been made by MEDALIST
CORPORATION to construct all off site lines and appurtenances necessary
to serve Lot 3 in accordance with said analysis and to provide
required easements therefor;
(c) Full compliance with all of DISTRICT's regulations,
ordinances and policies, including those relating to fees and the
California Environmental Quality Act of 1970, from time to time
applicable has been made.
(2) with respect to Lot 3 (Exhibit "B") no deposits for
expenses of a schematic layout and plan approval shall apply towards
MEDALIST CORPORATION's $3,000.00 contribution for an analysis of
Improvement District No. 4 and that the line sizes to be approved for
subdivision map purposes are subject to later revision upon completion
of the analysis and will be changed by MEDALIST CORPORATION at its
sole cost and expense upon DISTRICT's demand.
(3) With respect to Lot 2 (Exhibit "A"), while DISTRICT
has conditionally committed itself to furnish water thereto, it will
not furnish any water until MEDALIST CORPORATION has obtained from
all those interested in certain other lands within Improvement District
No. 4 their agreement that said other lands will not receive water
from the present system which will serve Lot 2 as an inducement to
DISTRICT's commitment, and that any deposits and fees paid on account
of plan approval and commitment shall not apply towards the $3,000.00
MEDALIST CORPORATION is to pay towards the Improvement District No.
4 analysis.
MEDALIST CORPORATION further acknowledges and agrees that
DISTRICT's approval of the waterworks system for the lands described
in Exhibits !lAIl and nB" shall in no way be construed to obligate
