The undersigned further establrshes that the total point assessment for Parcel

ROAD MAINTENANCE AGREEMENT
The purpose of this agreement 1S to provide for adequate
mainten~ce.of the roadway Welton Lane and Meadow Creek Lane
(formerly Sudan Road)" Poway, California The agreement is
executed by the parties herein, and will run with the land in
perpetui,ty' as a coqven~nt upon the property described herein-. The
standard of improvement shall be that set forth by the owners of
the property' descr;ib€d herein. maintaining or exceeding the
standard of improvements as they exist as of the date this document
is recorded
WHEREFO~E, the und~rsigned agree as follows:
1. PARTIES AND PROPERTY. The parties hereto are those
property owners who h~ve .executed this agreement and, their heirs,
executors, administrators, assignees, and successors in interest,
upon all whom th'isag'~eernent shall be binding. The realty held by
each party is identif;ied by the tax parce<l number adJacent to the
signature of each party The legal descr'{ption of the parcel upon
which the project is l~cated is set forth ih Exhibit "A" attached

3. MAINTENANCE. The costs of r,outine maintenance resulting

';;:lL not have occasion to use the full course of the
r,oad. For this reason, fairness dictates that only those
property owners commonly using a portion of that road
shall be ,maaeto bear the costs of maintaining that
portion of road Therefore, maintenance costs of
portions of th~ r,oad used only by certain persons,
because they are situated farther from the public access
road and beyond the boundaries of other owners, shall be
borne only by' those parties.
b. Maintenance of the road by all parties who use th,," road
in common shall be allocated in accordance with the
following point system:
LEach Par.ty is allocated 10 points by virtues of
ownership of a lot -
2. For a structure not used more than 30% of the time,
20 additional points
3. For a str,ucture which 11'3 used more than 30% of the.

5. INITIATION MiD MANAGEMENT OF REPAIRS.
8. Necessar-y maintenance, repairs, and or capital

parties as defined in section "c" of this paragraph,

a safe roadway for the wel fare of all residents.

6., ADMINISTRATION OF COSTS. The property owners or owners

making the payments requ&red for the work of improvement. It shall
be incufutent upon allp;:"operty owners to contribute to the general
fund to be used for maintenance or capital improvement in
accordance with the point, computations referenced above.
