AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
ESTABLISHING A MORATORIUM ON THE WITHDRAWAL
OF COMMERCIAL RENTAL UNITS FROM THE RENTAL MARKET
THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS:
Section 1. The conversion of commercial rental units to private
ownership constitutes a current and immediate threat to the public health,
safety and/or welfare of the community. Additional approval of
subdivision, rezones, land use permits, variances, building permits, or
any other applicable entitlement for use which is required in order to
comply with the Zoning Ordinance, would result in a threat to the public
health, safety and/or welfare.
Section 2. Ail zoning and regulatory ordinances notwithstanding, no
permits or approvals of any projects, as defined by the California Public
Resources Code, shall be accepted for processing or approval if said
project has the effect, either directly or indirectly, of decreasing the
number of available commercial rental units in the City of Poway.
Section 3. This Ordinance shall be of no further force and effect after
February 1, 1984.
Section 4. This Ordinance shall take effect thirty (30) days after
adoption and shall within fifteen (15) days of adoption be published with
the names of the Councilmembers voting for and against the same in the
Poway News Chieftain, a newspaper of general circulation, printed and
circulated within the City of Poway.
Introduced and first read at a regular meeting of the City Council of the
City of Poway held the 8th day of March, 1983, and thereafter PASSED AND
ADOPTED at a regular meeting of said City Council held the 15th day of
March 1983, by the following roll call vote:
