CC 1996 08-13 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL ADJOURNED REGULAR MEETING AUGUST 13, 1996 The August 13, 1996, meeting, adjourned from the August 6, lg96 regular meeting of the City Council of the City of Poway, was called to order at 4:40 p.m., by Mayor Higginson at the City Council Chambers, 13325 Civic Center Drive, Poway, California. COUNCILMEMBERS PRESENT AT ROLL CALL Mickey Cafagna, Bob Emery, Betty Rexford COUNCILHEMBERS ABSENT AT ROLL CALL Susan Callery, Don Higginson {Mayor Higginson arrived at 4:44 p.m.) STAFF MEMBERS PRESENT James Bowersox Marjorie Wahlsten John Fitch City Manager City Clerk Assistant City Manager PLEDGE OF ALLEGIANCE Deputy Mayor Cafagna led the pledge of allegiance. TOUR OF POTENTIAL POWAY COLLEGE CAMPUS SITES City Council left with staff, members of the Palomar Community College Board of Trustees and their staff, and members of the public to tour three sites in Poway that are being considered by the College District for satellite campuses. They are the southwest corner of Ted Williams Parkway at Pomerado Road, the Rheinhardt property on the west side of Pomerado Road, north of Via Monte Carlo, and the K- Mart\MegaFoods site at the northeast corner of Midland and Poway Roads. PUBLIC ORAL COMMUNICATIONS Mayor Higginson explained the procedure for Public Oral Communications. The following persons were present wishing to speak: Joye Davisson, 13733 Celestial Road, representing the Friends of the Library, stated they are requesting the City Council appoint a new Library Advisory Committee. Peggy Collette, 13969 Bernadotte Lane, stated she understands the ~Bad Boy act" she has been proposing cannot apply to past contracts, but suggested it be put in new contracts and cited the nudity issue in Lemon Grove as an example. CONSENT CALENDAR Motion by Councilmember Emery, seconded by Councilmember Rexford to approve the Consent Calendar as follows: Approval of Minutes - City Council July 16, 1996, Canceled Meeting July 23, 1996, Regular Meeting 7. Ratification of Warrant Register for period of July 22-26, 1996.{401-10) 5884 Page 2 - CITY OF POWAY - August 13, 1996 8. Receive and file Community Swim Center Quarterly Report. (1401-01) Appropriation of $95,000 to replace needed equipment and supplies destroyed by a fire in the trailer which housed the field operations division administrative staff at the Operations Center. (401-13) Motion carried unanimously. ITEM 4 (401-27) 1996-97 TAX P~ATES BOND INTEREST AND REDEMPTION Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. The City has one existing General Obligation Bond issue from the Poway Municipal Water District. In October, 1995, the City Council approved the refunding of the prior four general obligation bond issues which would reduce the property tax levy necessary to pay the outstanding principal and interest. The net result to the taxpayer is a reduction of over 60% in general property tax rates. A tax rate of $0.0231 is recommended for 1996-97, down fro $0.06022 in 1995-96. There was no one present wishing to speak. Motion by Councilmember Callery, seconded by Councilmember Emery to close the public hearing and adopt Resolution No. 96-092, entitled, 'A Resolution of the City Council of the City of Poway, California, Estimating the Amount Necessary to be Raised for Taxation for the Fiscal Year 1996-97 for Improvement Districts of the City Formerly known as Poway Municipal Water District." Motion carried unanimously. ITEM 4.1 (203-07) TEMPOP~ARY SIGNS FOR POWAY RODEO AND KINGSTON TRIO EVENTS Staff report by City Manager Bowersox. The Poway Days Chairman is requesting five 4' x 8' free standing signs to advertise the Poway Rodeo and four 3' x 8' banners to advertise the Kingston Trio concerts. Staff recommends this request be denied and the kiosk signs be utilized as directed in 1993. Councilmember Emery clarified that the rodeo signs being requested are the same that were used in the past. Speaking in opposition of staff recommendation: Fred Day, 13929 Olive Mesa Court, Executive Director of the Poway Chamber of Commerce Jay Goldby, 13244 Aubrey Street, President of the Poway Chamber of Commerce John Kennedy, 14136 Woodhollow Lane, Chairman of Poway Days 5885 Page 3 - CITY OF POWAY - August 13, 1996 Speakers cited the importance of the Poway Days events to the community. Following discussion, motion by Councilmember Emery, seconded by Councilmember Callery to approve the Temporary Use Permit for the rodeo signs as requested, to deny the banners for the Kingston Trio concerts, unless they utilize the street light banners used in the past. Staff was directed to give them priority on the kiosks and amend the sign ordinance to allow the rodeo signs in the future. Motion carried unanimously. ITEM 4.2 (203-18) PRE-DEVELOPMENT CONFERENCE PACIFIC BELL MOBILE SERVICES City Manager Bowersox stated that Pacific Bell Mobile Services wishes to place a telecommunication facility at the water reservoir on Boca Raton Lane. It will require a Conditional Use Permit. They are seeking feedback from the City Council prior to submitting an application. Heather Johnson was present from Pacific Bell Mobile Services. She stated the facility would be identical to the one recently approved for the Pomerado Reservoir. Council concurred that they should meet with the neighbors to get their feedback before proceeding. CITY ATTORNEY ITEMS 11. City Attorney Eckis stated that he has joined the amicus brief in the case of Breneric v. City of Del Mar. The City of Del Mar denied a development review application. The Court overturned their decision and said it must be allowed. The property owner has sued the City for a temporary taking. MAYOR AND CITY COUNCIL-INITIATED ITEMS 14. Councilmember Emery stated he had received a letter from a citizen regarding the lack of landscaping or need to remove weeds from landscaping at the western entrances to the City. Staff will report back.
