A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT08-07
TO HOLD A FUNDRAISING CARNIVAL
WHEREAS, Temporary Use Permit 08-07, St. Gabriel's Church Knights of
Columbus, Applicant, requests approval to hold a fundraising carnival on a vacant,
Redevelopment Agency-owned lot at 13023 Poway Road, with parking to be
accommodated at the City-owned lot at the northwest corner of Poway Road and
Tarascan Drive, from Thursday, March 13, 2008, through Sunday, March 16, 2008, with
hours of operation from 5:00 p.m to 10'00 p.m. on Thursday and Friday, and 1 00 p.m
to 10'00 p.m. on Saturday and Sunday; and
WHEREAS, on March 11, 2008, the City Council considered the above-
referenced item.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway, as follows.

Section 1 The City Council finds that Temporary Use Permit 08-07 is Categorically
Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to
Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will

have no permanent effect on the environment.
Section 2: The proposed use is in accordance with the purposes and standards of
Section. 17.26 030.A of the Poway Municipal Code
Section 3 The City Council hereby approves Temporary Use Permit 08-07, the
fund raising carnival on a vacant, Redevelopment Agency-owned lot on Poway Road,
with parking to be accommodated at the City-owned lot at the northwest corner of
Poway Road and Tarascan Drive, from Thursday, March 13, 2008, through Sunday,
March 16, 2008, with hours of operation from 5'00 p.m. to 10'00 p m. onThursday and
Friday, and 1'00 p.m to 10'00 p.m. on Saturday and Sunday, subject to the following
conditions:
A. The event and related off-site parking shall be conducted as shown on the site
plans and application on file in the Development Services Department.
B This permit is valid between the hours of 5 00 P m. on Thursday, March 13, 2008,
and 10'00 pm. on Sunday, March 16, 2008, after which time the site shall be
restored to its original condition
C The carnival site can begin setting up Wednesday, March 12, 2008, and shall be
removed by Tuesday, March 18, 2008

D Approval of this activity shall not excuse compliance with all other sections of the
Zoning Ordinance and all other applicable State, County, and City Ordinances
presently in effect.
E. The site shall be developed in accordance with the approved site plan on file in
the Development Services Department, Planning Division, except as otherwise
provided herein.
F Prior to the event, the applicant shall comply with the following:
1 Provide the City an insurance policy naming the City of Poway as
additionally insured in the amount of $1 million.
2. Vendor's licenses shall be obtained from the City of Poway Customer
Services Department for all temporary sales locations.
3 Obtain appropriate approvals from the California Department of Alcohol
Beverage Control (ABC) and the San Diego County Health Department.
4 The applicant shall have individuals designated at all times, and at specific
locations, to provide liaison with representatives of the City's Safety
Services and Sheriff's Departments.
5 All existing trees upon the carnival site shall be protected prior to and
during the event.
6 Appropriate dust control measures shall be taken prior to and during the
event.
7 The site shall not have any type of activity before 7'00 a.m. on any day
prior to, during, or following the event.
8 Both lots shall be cleared of all debris on a daily basis, and be kept in a
neat and orderly manner
9 Both sites shall be kept locked prior to, and following, the event. On days
of the event, the sites shall be locked during non-operating hours of the
carnival.
G During the event, the applicant shall comply with the following
1 Prior to and during the event, emergency vehicle access to any street, fire
lane, building, fire hydrant, or fire sprinkler system connection shall not be
blocked on either site

2. The maximum travel distance to a portable fire extinguisher shall not
exceed 75 feet.
3 Provide a class "K" fire extinguisher at any booth where grease-producing
cooking is done.
4 All compressed gas cylinders must be secured from falling over
5 Obtain a permit from the Fire Department for any canopy that exceeds
400 square feet or any tent that exceeds 200 square feet.
6 All driveways fronting Poway Road from the Tarascan Drive lot shall
remain closed during the event.
7 A crossing guard must be present during the entire event to assist
pedestrians crossing Poway Road between the Tarascan Drive parking lot
and the carnival site
H At the conclusion of the event, the applicant shall comply with the following:
1 Public streets, the off-street parking site, and areas within and adjoining
the proposed area for the event shall be cleared of debris, litter, temporary
signs, and all other evidence of the event.
Section 4 This approval shall become null and void on Tuesday, March 18, 2008, at
10'00 p.m., at which time the site utilized shall have been restored to its original
condition
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
State of California, at a regular meeting this 11 th day of March 2008
