MINUTES OF THE CITY COUNCIL REGULAR MEETING
OCTOBER 29, 1996
The October 29, 1996, regular meeting of the City Council of the City of
Poway, was called to order at 7:03 p.m., by Mayor Higginson at the City Council
Chambers, 13325 Civic Center Drive, Poway, California.

PRESENTATION
Councilmember Emery presented a proclamation for November 3-9, 1996, "Poway High
School Key Club Week", to Christine Bloczynski and other members of the Poway
High School Key Club.
PUBLIC ORAL COMMUNICATIONS
Mayor Higginson explained the procedure for Public Oral Communications. The
following persons were present wishing to speak:
Chris Cruse, 13734 Utopia, requested records regarding the City's cost of
defending the lawsuit brought by the Poway Royal Mobile Estates Homeowners.
Karen Boyle, 13884 Belvedere Drive, requested diaper changing tables in the
park restrooms; running water at all times in the park restrooms; and a first aid
station at Poway Days.

Adoption of Resolution No. 96-111, entitled, "A Resolution of the City
Council of the City of Poway, California approving the Application for
Grant Funds for the Environmental Enhancement and Mitigation Program under
Section 164.56 of the Streets and Highways Code for the Acquisition of
Property Adjacent to Blue Sky Ecological Reserve." (401-30)
Adoption of Resolution No. P-96-76, entitled, "A Resolution of the City
Council of the City of Poway, California Establishing a Process for
Implementation of Assembly Bill 771 and Acknowledging a time Extension
Pursuant to Government Code Section 66452.13 for Eligible Tentative Maps,"
providing for an automatic one-year extension of tentative maps and
direction to staff to prepare a Subdivision Ordinance amendment for
consideration of a five year extension. (203-01)

MINOR CONDITIONAL USE PERMIT 96-07
APPLICANT: NORM SNIDER
Mayor Higginson opened the public hearing. Staff report by City Manager
Bowersox. This is a request to allow rental and sales of recreational vehicles
and cars, minor service and repairs, sales of parts, and supplies and accessories

for recreational vehicles at 12538 Poway Road. The property is currently
occupied by the Classic Car Company which is a non-conforming use. The applicant
is proposing to modify the use of the site to include the rental of recreational
vehicles and cars for towing. Staff recommends approval.
There was no one present wishing to speak.
Motion by Councilmember Cafagna, seconded by Councilmember Emery to close the
public hearing and adopt Planning Resolution No. P-96-78, entitled, 'A
Resolution of the City Council of the City of Poway, California Approving Minor
Conditional Use Permit 96-07, Assessor's Parcel Number 317-540-20." Motion
carried unanimously.
ITEM 2 (203-08)
CONDITIONAL USE PERMIT 89-05
ANNUAL REVIEW/CALMAT-POWAY
Staff report by City Manager Bowersox. This is the fifth annual monitoring
report for the CalMat Conditional Use Permit/Reclamation Plan. CalMat has
demonstrated their conformance with the conditions of approval. When they
propose to resume operations they are required to submit written notice to the
Planning Services Department and a complete assessment of conditions will occur
at that time. Although noted in the comments of the staff report, no recycling
of asphalt will be done without further information.
Councilmember Rexford asked if CalMat had a response to Jim Rostvet's written
request for them to change the address from Beeler Canyon Road to Kirkham Way
since that road is now their access.
Bob Imler, 5475 Mission Center Road, San Diego, CalMat's representative, stated
that the address is being changed. He also stated that improved landscaping will
be installed.
Council concurred to receive and file the report.
ITEM 3 (203-21)
SPECIFIC PLAN AMENDMENT 84-01GG
Staff report by Director of Planning Services Wright-Quastler. Initiation of an
amendment to the South Poway Specific Plan to allow a one-third acre minimum lot
for a portion of Lot 90, Pomerado Business Park, and allowing a waiver of the 40
foot minimum setback from the right-of-way for parking aisles on low traffic
volume, non-collector streets is proposed.
Motion by Councilmember Cafagna, seconded by Councilmember Callery to adopt
Resolution No. 96-112, entitled, "A Resolution of the City Council of the City
of Poway, California Initiating an Amendment to the South Poway Specific Plan,
Specific Plan Amendment {SPA 84-01GG)." Motion carried unanimously.

MINOR CONDITIONAL USE PERMIT 94-02M
APPLICANT: BAN CARUSO/STIX FAMILY BILLIARDS
Staff report by Director of Planning Services Wright-Quastler. The modification
to Minor Conditional Use Permit 94-02 to serve beer and to extend the hours of
operation was approved on October 15, 1996 for a six month period. The
confirming resolution was on the October 22, 1996 agenda and continued to this
meeting in order to clarify with the ABC if they would issue a six month permit.
Staff has confirmed that the ABC issues a license which is renewed annually,
unless the operation is not in conformance with local regulations. They will
issue a license even with a temporary approval.
Dan Caruso, 1465 Grand Avenue, San Diego, stated he has not been able to confirm
with the ABC that the wording of the approval is okay, but if staff says they
have talked to them and it is okay, then he is comfortable with it.
Motion by Councilmember Emery, seconded by Councilmember Cafagna to adopt
Resolution No. P-96-79, entitled, "A Resolution of the City Council of the City
of Poway, California Approving a Request to Modify Minor Conditional Use Permit
94-02, Assessor's Parcel Number 317-153-24," and authorized the City Attorney to
change the wording, if necessary, to satisfy the Alcoholic Beverage Control.
Motion carried 4-0 with Councilmember Rexford abstaining since she was absent
form the October 15, 1996 meeting.
CITY MANAGER ITEMS

City Manager Bowersox stated that there will be a dumpster provided for
one week after the election behind the Fire Station in order for the
candidates to dispose of their election signs.
CITY ATTORNEY ITEMS

City Attorney Eckis requested a closed session for existing litigation in
the case of Britt-Hay v. City of Poway, San Diego Superior Court Case No.
700304.
CLOSED SESSION
Mayor Higginson called for a closed session at 7:25 p.m.
CALL TO ORDER AND ADJOURNMENT
Mayor Higginson called the meeting back to order at 7:40 p.m. and adjourned it
on motion by Councilmember Emery, seconded by Councilmember Callery.
