MINUTES OF THE CITY COUNCIL ADJOURNED REGULAR MEETING
NOVEHBER 26, 1996
The November 26, 1996, meeting, adjourned from the November 19, 1996
regular meeting of the City Council of the City of Poway, was called to order at
5:33 p.m., by Mayor Higginson at the City Council Chambers, 13325 Civic Center
Drive, Poway, California.

PUBLIC ORAL COMMUNICATIONS
Mayor Higginson explained the procedure for Public Oral Communications. There
was no one present wishing to speak.
CITY ATTORNEY ITEMS
City Attorney Eckis requested two closed sessions: one to discuss existing
litigation pursuant to Government Code Section 54956.9{a), in the case of Poway
Property Owners v. City of Poway, San Diego Superior Court Case No. 698367; and
one pursuant to Government Code Section 54956 to consider the employment of the
Assistant City Manager - Economic Development.
CLOSED SESSION
Mayor Higginson called for a closed session at 5:40 p.m. as requested by the City
Attorney.
CALL TO ORDER
Mayor Higginson called the meeting back to order at 6:15 p.m. and announced that
during closed session, on motion by Councilmember Rexford, seconded by
Councilmember Callery and passed unanimously, the Agreement of Waiver Settlement
and Mutual Release with John Fitch was amended in Section 4 to give 18 months
salary severance if resignation is within 181-270 days of June 4, 1996 and 12
months salary severance if resignation is within 271-365 days of June 4, 1996.

Upon motion by Councilmember Emery, seconded by Councilmember Cafagna, Mayor
Higginson ordered the meeting adjourned at 6:]8 p.m.
