CC 1996 12-12 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL ADJOURNED REGULAR MEETING DECEMBER 12, 1996 The December 12, 1996 meeting, adjourned from the December 10, 1996 regular meeting of the City Council of the City of Poway, was called to order at 5:15 p.m., by Mayor Higginson at the City Council Chambers, 13325 Civic Center Drive, Poway, California. There was no one present wishing to speak. ITEM 1 201-01) STANDARDIZED EMERGENCY MANAGEMENT SYSTEM (SEMS) TRAINING FOR COUNCIl Introduction by City Manager Bowersox. The Governor's Office of Emergency Services (OES) established, by regulation, a Standardized Emergency Management System (SEMS) to provide effective response to multi-agency and multi- jurisdiction emergencies in California. Tom Amabile, County Office of Disaster Preparedness, presented an overview of SEMS including Incident Command System, Multi-Agency Coordination, Mutual Aid, and Operational Area concept. In order to be eligible for funding of response-related personnel costs under the State disaster assistance program, local governments must adopt SEMS. Poway is in compliance. (Councilmember Rexford arrived at 5:30 p.m.) 5968 Page 2 - CITY OF POWAY - December 12, 1996 ITEM 2 (701-11) IMPACT OF PROPOSITION 218 Introduction by City Manager Bowersox. In the November 1996 election, California voters approved Proposition 218 which affects the method local government can levy taxes, charge assessments, and collect fees. In Poway, 10,959 (62%) voted in favor of the proposition. Staff report by City Attorney Eckis, who discussed the impacts of Proposition 218 on the City's revenues. The Fire Protection Fee needs to be addressed because it does not satisfy the new requirements set by Proposition 218. There is a potential loss of this revenue source which generates $524,260 for the General Fund. Motion by Mayor Higginson, seconded by Councilmember Emery to direct staff to continue to explore options regarding a special election to place the Fire Protection Fee on the ballot for voter approval. Motion carried unanimously. ADJOURNMENT Mayor Higginson adjourned the meeting at 7:00 p.m. Mayor Higginson noted that a Special Meeting would be held following this meeting to discuss pending litigation in closed session. There was no one present wishing to speak. CLOSED SESSION City Attorney Eckis stated this special meeting was called to hold a closed session to discuss pending litigation, City of Poway v. Poway Venture Ltd., San Diego Superior Court Case No. 73859, consolidated with City of Poway v. Parkway Business Centre Partners, Ltd., San Diego Superior Court Case No. 672341 and City of Poway v. South Poway Associates, San Diego Superior Court Case No. 672339. Mayor Higginson called for a closed session as requested by the City Attorney at 7:22 p.m. CALL TO ORDER AND ADJOURNMENT Mayor Higginson called the meeting back to order at 9:15 p.m. and adjourned the meeting on motion by Deputy Mayor Rexford, seconded by Councilmember Emery. marjori~ K.
