The February 11, 1997, regular meeting of the City Council of the City of
Poway, was called to order at 7:03 p.m., by Mayor Higginson at the City Council
Chambers, 13325 Civic Center Drive, Poway, California.

CONDITIONAL USE PERMIT 94-07/VARIANCE 97-01
APPLICANT: MARILYN GILLISPIE/ROCKY MOUNTAIN RANCH
Mayor Higginson opened the public hearing. Staff report by Director of Planning
Services Wright-Quastler. This is a request to legalize an existing boarding and
training stable with pipe corrals and two barns set up to accommodate 65 horses
and to allow an existing mobile home as a second dwelling unit with a variance
to exceed the 25 percent ratio on a 15 acre site at 14875 Mina de Oro Road, north
of Poway Road. The application for a second dwelling unit does not meet the
criteria now in place for such units pursuant to Ordinance 456 and staff
recommends the variance not be approved and the trailer be removed by July 1,
1997.
Speaking in favor of staff recommendation:
Marilyn Gillespie, 14875 Mina de Oro, asked that the mobile home be
allowed to remain until the South Poway Parkway is completed. If the traffic
conditions on Poway Road change significantly at that time, the second unit may
be allowed and she would reapply for a variance. The mobile home is subject to
a divorce settlement and may be removed by her ex-husband in the next month.
Motion by Councilmember Cafagna, seconded by Councilmember Goldby to close the
public hearing; issue a Negative Declaration; and adopt Planning Resolution No.
P-97-04, entitled, 'A Resolution of the City Council of the City of Poway,
California Approving Conditional Use Permit 94-07 and Denying Variance 97-01
without Prejudice, Assessor's Parcel Number 321-111-10," allowing the trailer to
remain on the property until July 1, 1998 as long as it is unoccupied. Motion
carried 5-0.

COUNCIL SUBCOMMITTEE/PALOMAR COLLEGE
Mayor Higginson read from the minutes of January 7, lg97, when Councilmember
Cafagna requested that a subcommittee of the City Council meet with a
subcommittee of trustees from Palomar College. He and former Mayor Goldsmith
were appointed to such a Committee originally in 1990 which leaves him on the
Committee. He has three Councilmembers interested in filling the other position.
Assistant City Manager Fitch stated we have received a letter from Palomar
College requesting we refer to the site as a 'learning center" rather than a
'satellite campus" since it will not have the full facilities of a campus.
Motion by Mayor Higginson, seconded by Councilmember Goldby to
Councilmember Cafagna to the subcommittee to serve with Mayor Higginson.

Motion
Councilmember Rexford stated she has been working on this project with Assistant
City Manager Fitch for two years and wishes to serve on the Committee. As an
alternative, she suggested the full Council meet with Palomar since there is so
much interest on the part of the Councilmembers.
Mayor Higginson stated that all the Councilmembers will be able to give input to
the process.

ITEM 3 (702-02)
FIRE PROTECTION FEE ELECTION
Staff report by City Manager Bowersox. The passage of Proposition 218 requires
voter approval of the Fire Protection Fee which has been levied on the tax rolls
since 1983 and was originally established by the Poway Municipal Water District
in 1978 as a charge on the water bill. Total revenue from this source is
approximately $500,000 per year. Staff recommends this matter be placed on the
June 3, 1997 ballot.
Motion by Mayor Higginson, seconded by Councilmember Emery to appropriate $81,000
from the General Fund and direct staff to draft the final language for a ballot
measure that will keep the fire protection fee as it currently is, with no
changes. Motion carried 4-0 with Councilmember Rexford out of the room.
CITY ATTORNEY XTEMS
City Attorney Eckis requested a closed session to discuss existing litigation in
accordance with Government Code Section 54956.g(a), in the case of Generoso Russo
v. the City of Poway, San Diego Small Claims Case No. 660831.

Councilmember Emery announced that the meeting regarding light rail in the
1-15 corridor is scheduled for March 8, 1997 in Poway.
13. Councilmember Goldby announced that he will be absent from the February 25
and March 11 City Council meetings.
CLOSED SESSXON
Mayor Higginson called for a closed session at 7:34 p.m. It was held with all
Councilmembers except Councilmember Rexford.
CALL TO ORDER AND ADJOURNHENT
Mayor Higginson called the meeting back to order at 8:10 p.m. with all
Councilmembers present, except Councilmember Rexford, and adjourned the meeting.
