ORDINANCE NO 676
AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA,
ADDING SECTION 12.48.250 TO THE POWAY MUNICIPAL CODE
TO ESTABLISH UNDERGROUND UTILITY DISTRICT NO 66
AND AMENDING SECTION 1248160
WHEREAS, it is desirable to underground existing overhead utilities at the same
time as the planned road and drainage improvements on Oak Knoll Road from Poway
Road to 765 feet west of Carriage Road. The proposed boundaries of the underground
district are as shown on the attached drawing (Exhibit "A") attached hereto and
incorporated herein, and
WHEREAS, Section 12.48030 of the City of Poway, California, Municipal Code
permits the establishment of an Underground Utility District by Ordinance amending the
Municipal Code "if after such public hearing on the Resolution of Intention, the City
Council finds that the public health, safety, or welfare requires such removal and such
underground installation within a designated area", and
WHEREAS, the City of Poway held a public hearing on the Resolution of
Intention on June 10, 2008
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
ORDAIN AS FOLLOWS
Section 1 Section 12.48.250 shall be added to the Poway Municipal Code
designating the following as Underground Utility District No 66
All that unincorporated territory in the County of San Diego, State of California lying
within the following described boundaries.
Beginning at the Southeast corner of Section 15, Township 14 South, Range 2 West,
San Bernardino Meridian, thence Northwesterly along the Southerly line of Assessor
Parcels 316-120-08 and 316-120-19 to the Southwesterly line of said Assessor Parcel
316-120-19; thence along said Southwesterly line to the Northwesterly line of said
Assessor Parcel 316-120-19; thence along said Northwesterly line to a point of
intersection of the Southeasterly right-of-way of Poway Road and the Southwesterly
right-of-way of Oak Knoll Road; thence Northeasterly to the Southerly point of curve of a
2500 foot radius curve, concave Easterly on Assessor Parcel 316-120-16, said point
being on the Northeasterly right-of-way of Oak Knoll Road; thence along said
Northeasterly right-of-way to the Southwest corner of Parcel 1, Parcel Map No 18072;
thence along the Westerly line of said Parcel 1 to the Northwest Corner of said Parcel 1,
thence along the Northerly line of said Parcel 1 to the Northeast corner of said Parcel 1,
thence along the Easterly line of said Parcel 1 to the Southeast corner of said Parcel 1,
said point being on the Northerly right-of-way of Oak Knoll Road; thence along said

point on the Westerly line of Parcel 3 of Parcel Map No 455, thence along said

Southerly along said Westerly right-of-way to the Northerly point of curve at the

of curve of a 25 00 foot radius curve, concave Northeasterly, said 25 00 foot radius
curve being the Southwest corner of Assessor Parcel 317-540-36, said point of curve
being on the Northerly right-of-way of Oak Knoll Road; thence Easterly along said
Northerly right-of-way to the Southeast corner of Assessor Parcel 317-540-35, thence
Northerly along the Easterly line of said Assessor Parcel 317-540-35 to the Northeast
corner of said Assessor Parcel 317-540-35, thence Westerly along the Northerly line of
said Assessor Parcel 317-540-35 to the Southerly prolongation of the Westerly line of
Lot 1, Map No 7929; thence Northerly along said Southerly prolongation to the
Southwesterly corner of said Lot 1, thence Easterly along the Southerly line of said Lot
1, and a Easterly prolongation thereof to the Westerly line of Assessor Parcel No 317-
540-44, thence Southerly along said Westerly line and a Southerly prolongation thereof
to the Northerly right-of-way of Oak Knoll Road, thence Easterly along said Northerly

perpendicular line to said Northerly right-of-way Southerly to the Southerly right-of-way
of Oak Knoll Road; thence Westerly along said Southerly right-of-way to the Westerly
line of Map No 14479; thence Southerly along said Westerly line to the Northerly line of
Assessor Parcel No 317-501-07, thence Westerly along said Northerly line to the
Northwest corner of said Assessor Parcel 317-501-07, thence Southerly along said
Westerly line to the Northerly line of Map No 4442, thence Westerly along said
Northerly line to the Westerly line of said Map No 4442; thence Northerly along said
Westerly line to the Southerly line of Assessor Parcel 317-550-21, thence Easterly
along said Southerly line to the Westerly line of the East one-half of Section 14,
Township 14 South, Range 2 West, San Bernardino Meridian, being the Southeast
corner of said Assessor Parcel 317-550-21, thence Northerly along said Westerly line
of the East one-half to the Southerly right-of-way of Oak Knoll Road; thence Westerly
along said Southerly right-of-way to the Easterly line of Assessor Parcel 317-550-11,

Pomerado Road, thence Northerly along said Easterly right-of-way to the Southerly
point of curve of a 25 00 foot radius curve concave Southeasterly; thence on a
perpendicular line to said Easterly right-of-way Westerly to the Westerly right-of-way of
Pomerado Road; thence Southerly along said Westerly right-of-way to the Southeast
corner of Assessor 317-152-14, thence along the Southerly line of Record of Survey
3621 to the Easterly line of Section 22, Township 14 South, Range 2 West, San
Bernardino Meridian, thence along said Easterly line to the POINT OF BEGINNING
Section 2; Section 12.48 160 shall be amended to read as follows.
The provisions of Article I of this Chapter shall apply to all Underground Utility
Districts described in Sections 12.48 170 through 12.48.250
Section 3 This Ordinance shall be codified.
EFFECTIVE DATE. This Ordinance shall take effect and be in force thirty (30)
days after the date of its passage, and before the expiration of fifteen (15) days after its
passage, it shall be published once with the names of members voting for and against
the same in the Po way News Chieftain, a newspaper of general circulation published in
the City of Poway
Introduced and first read at a Regular Meeting of the City Council of the City of
Poway held the 1st day of July 2008, and thereafter PASSED AND ADOPTED at a
regular meeting of said City Council held the 15th day of July, 2008, by the following roll
call vote
