CC 1997 05-06 CITY OF POWAY, CALIFORNIA MXNUTES OF THE CZTY COUNCIL REGULAR NEETING MAY 6, 1997 The May 6, 1997, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Deputy Mayor Rexford at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PROCLAMATION Deputy Mayor Rexford read the proclamation for "National Family Child Care Appreciation Day," May 9,1997. Lisa Murphy was present to accept it. PRESENTATION Aaron Knox of Harley Knox & Associates described their public education program regarding Proposition A, the June 3,1997 special election fora Fire Protection Tax, including direct mail, newspaper advertisement, information on the City's website, and speaking before community groups. Director of Safety Services Sanchez and Assistant to the City Manager Riley will make the presentations. Councilmember Emery asked if Councilmembers could help with the presentations. City Manager Bowersox stated that since the City Councilmembers have written an 6067 Page 2 - CITY OF POWAY - May 6, 1997 argument in favor of Proposition A, they are not impartial and cannot be involved in the information campaign. The City can inform, but City funds cannot be used to promote passage of the Proposition. PUBLIC ORAL COMMUNICATIONS Deputy Mayor Rexford explained the procedure for Public Oral Communications. There was no one present wishing to speak. CONSENT CALENDAR Motion by Councilmember Emery, seconded by Councilmember Cafagna to approve the Consent Calendar as follows: e Approval of Minutes - City Council: April 15, 1gM7 Regular Meeting 4. Ratification of Warrant Register for period of April 14-18, 1997(401-10) e Approval of Comprehensive Annual Financial Report for Fiscal Year ending June 30, 1gM6. (406-02) Receive and file Status Report regarding staff approval of Development Reviews in the South Poway Business Park. {203-14) o Approval of Project Management Contract with P&D/CTE Engineers, Inc. in the amount of $158,020 for the 97-98 Street Maintenance Program. (602-01 #1200) Ge Approval of Amendment No. 3 to the Agreement Between the County of San Diego and the City of Poway for Public Transportation Services, 1994-95 through 1997-g8, to implement service levels approved on March 25, 1997. (602-01 #35) Receive and file update of Speed Surveys for 28 road segments, as required by Section 40802 of California Vehicle Code, with no changes in posted speed limits. (1160-02) 9.1 Approval of positions on pending legislation: support AB 211 which concerns booking fees; oppose SB 1179 which would prohibit any City from enacting an ordinance, franchise, or contract that indemnifies the City against potential fines imposed by the California Integrated Waste Management Board for failure to achieve AB 939 goals; and support AB 432, which concerns youth marijuana use penalties. (701-11) Motion carried 4-0 with Mayor Higginson absent. 6068 Page 3 - CITY OF POWAY - May 6, 1gM7 ITEM 1 (701-04) ORDINANCE NO.473/SECOND READING HIGH VOLUME SEWER USERS Deputy Mayor Rexford stated that staff is recommending this item be continued to May 20, 1gM7 in order to correct a legal noticing problem. It will be brought back for first reading at that meeting. Motion by Councilmember Cafagna, seconded by Councilmember Emery to continue Ordinance No.473 to May 20,1gg7 for a first reading. Motion carried 4-0 with Mayor Higginson absent. CITY ATTORNEY ITEMS Assistant City Attorney Smith requested two closed sessions with the City Council. The first is existing litigation, Poway Royal Mobile Home Owners Association v. City of Poway, San Diego Superior Court Case No. 682581; and the second is anticipated litigation with one potential case. MAYOR AND CITY COUNCIL-INITIATED ITEMS 14. Councilmember Goldby stated he had recently read some incorrect statements in a local group's newsletter and felt the City needs to make an effort to counter negative and incorrect information. CLOSED SESSION Deputy Mayor Rexford adjourned the meeting into closed session at 7:35 p.m. CALL TO ORDER AND ADJOURNMENT Deputy Mayor Rexford called the meeting back to order at 8:55 p.m. and adjourned on motion by Councilmember Cafagna, seconded by Councilmember Emery.
