PROCLAMATION Councilmember Emery read the proclamation for Emergency Medical Services Week, May 18-24, 1997, and presented it to Director of Safety Services Sanchez. Councilmember Rexford read the proclamation for National Public Works Week, May 18-24, 1997 and presented it to Director of Public Services Williams. PUBLIC ORAL COMMUNICATIONS Mayor Higginson explained the procedure for Public Oral Communications. There was no one present wishing to speak. (1502-17) Approval of Final Conservancy, owner; Montauk Street. Map for Tentative Parcel Map 96-11, The Nature located at the southeast corner of Metate Lane and (2o3-o2) Award of Bid for Automotive Kiosk Structures to Fast Signs - Escondido in the amount of $16,243.31. {602-01 #1201) Adoption of Planning Resolution No. P-97-24, entitled ~A Resolution of the City Council of the City of Poway, California, Approving Comprehensive Sign Program 79-06M(2), Assessor's Parcel Numbers 317-490-55," Stanford Sign, applicant: request to modify previously approved comprehensive sign program for Carriage Center; located at 12845 Poway Road, Suite 400 (currently occupied by Poway Dental Care). (203-15) Approval of Lease Agreement Between the City of Poway and Cox Communications PCS, L.P. for the Installation and Operation of A~tenna Facilities on the Pomerado Reservoir Site. (602-01 #1202) Approval of positions on pending legislation: oppose SB 994 which will prohibit local entities from directly prohibiting a licensed contractor from bidding on local public works or services contracts; oppose AB 1070 which will provide that a public agency may not require a design professional to indemnify the public agency; and oppose AB 940 which would limit the amount of retention proceeds on public works projects that may be withheld. {701-11) Motion carried unanimously. ITEM i (1301-07) RED LIGHT PHOTO CITATION PROGRAM Item introduced by City Manager Bowersox. Staff report by Director of Engineering Services Weston. Only two of the five intersections were operational for the full three-month reporting period, and tickets were only able to be issued to 18% of the photos taken due to various factors including poor picture quality. However, there appears to be a positive influence on driver behavior and general traffic safety. Staff has prepared Resolutions of Intention setting public hearings for the landscape maintenance districts and lighting district to levy and collect assessments for 1997-98. There are no increases proposed in the assessments. Because of the passage of Proposition 218, it will be necessary to put to a public vote any increases proposed in future years. Motion by Councilmember Emery, seconded by Councilmember Rexford to take the following actions: Adopt Resolution No. 97-030, entitled, 'A Resolution of the City Council of the City of Poway, California Declaring the Intention to Levy and Collect Assessments within Poway Landscape Maintenance District 83-1 for Fiscal Year 1997/978," approving the Engineer's Report recommending assessments of $118.48 per year in Zone A and $255.34 per year in Zone B, and setting public hearing for July 1, 1997. Adopt Resolution No. 97-031, entitled, 'A Resolution of the City Council of the City of Poway, California Declaring the Intention to Levy and Collect Assessments within Poway Landscape Maintenance District 86-1 for Fiscal Year 1997/98," approving the Engineer's Report recommending assessments of $261.00 per year in 6O72 Page 4 - CITY OF POWAY - May 13, 1997 Zone A and $-0- per year in Zone B, and setting public hearing for July 1, lg97. Adopt Resolution No. 97-032, entitled, mA Resolution of the City Council if the City of Poway, California Declaring the Intention to Levy and Collect Assessments within Poway Landscape Maintenance District 86-2 for Fiscal Year 1997/98,' approving the Engineer's Report recommending assessments of $186.16 per year in Zone A and $240.90 per year in Zone B, and setting public hearing for July 1, 1997. Adopt Resolution No. 97-033, entitled, mA Resolution of the City Council of the City of Poway, California Declaring the Intention to Levy and Collect Assessments within Poway Landscape Maintenance District 86-3 for Fiscal Year 1997/98," approving the Engineer's Report recommending assessments of $163.00 per year in Zone A and $113.80 per year in Zone B, and setting public hearing for July 1, 1997. Adopt Resolution No. 97-034, entitled, mA Resolution of the City Council of the City of Poway, California Declaring the Intention to Levy and Collect Assessments within Poway Landscape Maintenance District 87-1 for Fiscal Year 1997/98," approving the Engineer's Report recommending assessments for various projects and approving the collection of monies in lieu of assessments from the City and the Redevelopment Agency, and setting public hearing for July 1, 1997. Adopt Resolution No. 97-035, entitled, mA Resolution of the City Council of the City of Poway, California Declaring the Intention to Levy and Collect Assessments within Poway Lighting District for Fiscal Year 1997/98," approving the Engineer's Report recommending assessments of $15.00 per year in Zone A, $3.75 per year in Zone B and $13.58 per year in Zone C, and setting public hearing for July 1, 1997. Motion carried unanimously. CITY ATTORNEY ITEMS Assistant City Attorney Smith requested a closed session to discuss existing litigation, Poway Royal Mobile Home Owners Association v. City of Poway, San Diego Superior Court Case No. 682581. MAYOR AND CITY COUNCIL-INITIATED ITEMS 19. 22. Councilmember Emery stated he has read that the City of San Diego may bid to purchase the Sycamore Canyon landfill from the County of San Diego and asked how that could affect the City of Poway's tipping fees. Council concurred that we should stay "on top" of that process. Mayor Higginson stated he was appointing Marilyn Bayne to the Senior Issues Committee. 6O73 Page 5 - CITY OF POWAY - May 13, 1997 CLOSED SESSXON Mayor Higginson called for a closed session at 7:25 p.m. as requested by the Assistant City Attorney.
