COVENANT REGARDING REAL PROPERTY
Laszlo Gal and Agnes Christina Gal, As Trllstees, or the Successor Trustee, of the Gal
Family Trust Dated AlIgust 21, 1998, PROPERTY OWNERS ("OWNER" hereinafter), are the
owners of real property commonly known as 18770 Heritage Drive ("PROPERTY" hereinafter) and
more fllily described as:
Lot 23 of Poway Tract No, 98-02 Heritage Ranch Estates, in the City of Poway, County of
San Diego, State of California, according to map thereof Nb 14388, filed in the Office of the
County Recorder of San Diego County, May 8, 2002,
In consideration of the approval by the City of poway ("CITY" hereinafter) of Minor
Development Review Application (MDRA) 05-04R, a request to construct a new 10,029-square-
foot, two-story, single-family residence, with a 1 ,322-square-foot detached garage, and a detached
1, 136-sqllare-fDot guest hOllse, OWNER hereby agrees that no portion of the gllest house shail
ever be rented or leased as a separate unit and kitchen facilities shail never be instailed No
natural gas connection or 220V electricity is permitted in the guesthouse kitchen area,
This Covenant shail run with the land and be binding upon and inllre to the benefit of the
fllture owners, encumbrancers, successors, heirs, personal representatives, transferees and
assigns of the respective parties,
In the event that MDRA 05-04R expires or is rescinded by City Council at the request of the
OWNER, CITY shail expunge this Covenant from the record title of the PROPERTY
in the event of litigation to enforce the provisions of this Covenant, the prevaiiing party
shail be entitled to fllll reimbursement of ail costs, including reasonabie attorneys' fees, from the
other party
