COVENANT REGARDING REAL PROPERTY
Lane W Freestone and Silvana A, Freestone, trustees of the Freestone Family Trust,
PROPERTY OWNERS ("OWNER" hereinafter), are the owners of real property commonly known
as 13031 Via Del Toro {PROPERTY" hereinafter) and more fully described as:
Lot 64 of Valle Verde Estates Unit Nq, 2, in the City of Pbway, County of San Diego, State
of California, according to map thereof No, 4894, filed in the Office of the County Recorder of San
Diego County on January 16, 1962,
In consideration of the approval by the City of Poway ("CITY" hereinafter) of Minor
Development Review Application (MDRA) 06-71, a request to construct a new 1,052-square-foot
garage, convert an existing 623-square'foot,garage into a family room, and add 855-square-feet of
I,iving area (family room and master' bedroom addition) at an existing single,family residence,
- OWNER hereby agrees-that no portion-of the gllest. house/family room-shall ever be rented or
lei3sed as a separate unit, and kitchen facilities shall never be installed, No natllral gas connection
or 220V electricity is permitted in this area,
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrancers, successors, heirs, personal representatives, transferees and
assigns of the respective parties,
In the event that MDRA 06-71 expires or is rescinded by City Council at the request of the
OWNER, CITY shall expunge this Covenant from the record title of the PROPERTY
In the event of litigation to enforce the provisions of this Covenant, the prevailing party
shall be entitled to fllll reimbursement bf all costs, including reasonable attorneys' fees, from the
other party
