Royce Conway (hereinafter "GRANTOR") hereby grants to CITY OF POWAY, (hereinafter
"GRANTEE"), its successors, -or assigns, the Temporary Construction Easement and incidents
thereto for construction of a CDS Stormwater Treatment Unit within Aubrey Street right-of-way,
across that certain real property in the City of Poway, County of San Diego, State of California,
described as follows:
The northerly 20 feet of the easterly 60 feet of'APN No. 314-201-46
- .-- --~- The GRANTOR, here-by further grants to the City of Poway the privilege and right to extend
excavation and embankment slopes within the limits of the herein described Temporary
Construction Easement, forthe construction of said CDS Stormwater Treatment Unit.
The GRANTOR, for himself, his successors and assigns, hereby waives any claim for any and
all severance damages to GRANTOR's remaining property contiguous to the Temporary
Construction Easement. Said severance damage relates to the market value of the home.
The GRANTOR hereby further gra!1t~ to GRANTEE the right to temporarily enter said described
property and construct necessary related improvements as part of the proposed construction
process. The GRANTEE hereby accepts liability for the"construCtion activity ther~in and shall
repair or replace all landscaping and existing 'improvements damaged or adversely impacted by
the aforementioned .construction work. Said repa!rs'shall ,be made to the satisfaction of
GRANTOR, This Temporary Construction Easemerit, as described, shall be valid only until the
construction has been accepted by the GRANTEE. After such time, this Temporary
Construction Easement shall become null and void,
