COVENANT REGARDING REAL PROPERTY
Douglas L. Fronius and Mae T Fronius, Husband and Wife as Joint Tenants ("OWNERS"
hereinafter), are the owners of real property commonly known as Assessor's Parcel Number
314-750-13 ("PROPERTY hereinafter), and more fully described as.
Lot 13 of City of Poway Tract 4113"3, in the City of Poway, County of San Diego,
State of California according to Map thereof No 11508 filed in the Office of the
County Recorder of San Diego County, May 8, 1986
In consideration of the approval of a Building Permit to construct a 621-square-foot,
detached garage and a 309-square,foot recreation room on the above-referenced property by the
City of Poway ("CITY" hereinafter), OWNERS hereby agree that the detached garage/recreation
room .shall never be rented or leased as a separate unit, the garage area shall never be used as
living 'spclce and will not have heating or air conditioning, and no kitchen facilities shall be installed
- in.the recreation.roomarea.
, This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrance's, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that a Building Permit is never obtained to construct the proposed garage/
recreation room at the request of the OWNERS, the CITY shall expunge this Covenant from the
record title of the PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs; including reasonable attorneys'
fees, from the other party The CITY may assign to persons impacted by the performance of this
Covenant the right to enforce this Covenant against the OlNJERS. ~
