COVENANT REGARDING REAL PROPERTY
James Robert SI. John and Patricia Ann SI. John, Trustees of the SI. John Family Trust
dated March 17, 1994, and Christopher J Coseo and Brenda M. Coseo, Trustees of the Coseo
Family Trust dated October 16, 2002, property owners ("OWNERS" hereinafter) of real property
("PROPERTY hereinafter), commonly known as Assessor's Parcel Number 227-220-15, and
further described as follows.
LOT 15 OF CITY OF POWAY TRACT NO 98-02, HERITAGE RANCH
ESTATES, PHASE 1, UNIT 1, IN THE CITY OF POWAY, COUNTY OF SAN
DIEGO, STATE OF CALIFORNIA, ACCORDING TO MAP THEREOF NO 14388
- - FILED IN-THE 0FFICE OF THE COUNTY RECORDER OF SAN DIEGO
COUNTY, MAY 8,2002.
In consideration of the approval by the City of Poway ("CITY" hereinafter) of MDRA
04-54 to construct an 8,760-square-foot, single-family residence, including a 728-square-foot
guest unit, and a 1 ,516-square-foot garage on the referenced property, Owner agrees to the
following:
NO PORTION OF THE GUEST UNIT SHALL EVER BE RENTED OR LEASED
AS A SEPARATE UNIT AND THAT NO KITCHEN FACILITIES SHALL EVER
BE INSTALLED
This Covenant shall run with-the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that a Building Permit is never obtained to construct the proposed
residence, CITY shall at the request of OWNERS, expunge this Covenant from the record title
of PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable
attorneys' fees, from the other party The CITY may assign to persons impacted by the
performance of this Covenant the right to enforce this Covenant against OWNERS
