Jamil, husband and wife as joint tenants ("OWNER" hereinafter), are the owners of real property commonly known as Assessor's Parcel Number 317-661-15 ("PROPERTY hereinafter), and more fully described as: Lot 3 of Westgate Unit No.1, in the City of Poway, County of San Diego, State of California, according to Map thereof No 6950, filed in the Office of the County Recorder of San Diego County, California, June 1, 1971 In consideration of the approval of a Building Permit to construct a 488-square-foot, detached guest house on the referenced property by the City of Poway ("CITY" hereinafter), OWNER hereby agrees that the detached guest house shall never be rented or leased as a separate unit, no complete kitchen facilities shall be installed, and no gas line and/or 220 ampere electrical service shall ever be installed except for in the. water_ heater area,_and.used_solely_for water heater purposes. This Covenant shall run with the .Iand and be binding upon and inure to the benefit of the future owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the respective parties. In the event that a Building Permit is never obtained to construct the proposed guest house at the request of the OWNER, the CITY shall expunge this Covenant from the record title of the PROPERTY If either party is required to incur costs to enforce the provisions of this Covenant, the prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party The CITY may assign to persons impacted by the performance of this Covenant the right to enforce this Covenant against the OWNERS --D~ted: 1/2-Y/61-, ~;Y I I M.
