COVENANT REGARDING REAL PROPERTY
Whereas Stephen K. Horn and Kathryn K, Horn, as Trustees of the Stephen and Kathryn
Horn Living Trust, dated May 10, 1999, PROPERTY OWNERS ("OWNERS" hereinafter), are
the owners of real property commonly known as Assessor's Parcel Number 277-220-19
("PROPERTY" hereinafter), and more fully described as:
LOT 19 OF CITY OF POWAY TRACT NO 98-02, IN THE CITY OF POWAY,
COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, ACCORDING TO MAP
THEREOF 14388, FILED IN THE OFFICE OF THE COUNTY RECORDER OF SAN
DIEGO COUNTY, MAY 8,2002,
In consideration of the approval by the City of poway ("CITY" hereinafter) of Minor
DevelopmjOnt Revie,,! I>,pplil::?tion04,111 (MDRA 04-11'1), ihvolving the construction cif a

911-square-foot guest house, OWNERS hereby agree that. no portion of the guest unit shall
ever bererited or leased as a separate unit. complete kitchen facilities shall not be installed, and
'no gas line and/or 220 ampere electrical service shall ever be installed. for the purposes of a
kitchen facility
This Covenant shall run with the .Iand and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal' representatives, transferees and
assigns of the respective parties.
In the event of litigation to enforce the provisions of this Coyenant, the prevailing party
shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees. from the
other party
