COVENANT REGARDING REAL PROPERTY
Whereas Daniel Frank, Schaiteland Janet Kay Schaitel, Husband and Wife las Joint
Tenants,PROPERTY OV)/NERS("OWNER" hereinafter) are the owners of real property commonly
known as Assessor's Parcel Number3'14-812c15 ("PROPERTY" hereinafter), and more fully
described as.
Lot 409 of City of poway Tract No 4191-5AR, in the City of Poway,
County of San Diego, $tate <if California, according to Map thereof
No 12356, filed in the Office of the County Recorder of San Diego County,
California, April 27, 1989
In consideration of the ,approval by the City of Poway ("CITY" hereinafter) of a Building
Permit to construct an 893-square-footworkshop, OWNER hereby, agrees that no portion of the

This Covenant shall run with the land and be binding upon and inure to the benefit of the
future' owners, encumbrancers, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the,event thattheSchaitelworkshop is rescinded by City Council, and building permits are
never obtained to construct the proposed addition, CITY sheill, aUhe:request of OWNER, expunge
this Covenant from the record title of PROPERTY
In the event.oflitigationto eriiorcethe provisions of this Govenant, the prevailing party shall
be entitled to fuJI reimbursement.ofallcosts, including reasonatile:attorneys' fees, from the other
party
