COVENANT REGARDING REAL PROPERTY
Michael W Devine and Gwen J, Devine, hllsband and wife as joint tenants ("OWNERS"
hereinafter), are the owners of real property commonly known as 11733 Treadwell Drive
("PROPERTY hereinafter), and more fully described as:
Lot 51 of City of poway TraGi No 88-D4R, in the City of Poway, County of San Diego,
State of California, according to the Map thereof No, 13364, filed in the Office of the County
Recorder of San Diego County, October 17,1996,
In consideration of the approval ofa Building Permitto construct a detached poolhouse
on the referenced property by the City of Poway ("CITY" hereinafter), OWNER hereby agrees
that the detached pool house shall never'be rented or leased' as a separate unit, no complete
kitchen facilities shall be installed, and no gas line and/or 220 ampere electrical service shall
ever be installed, except in the water heater area and then used solely for water heater

This Covenant shall run with,the land and be binding Lipon and inure to the benefit of the
future owners, encumbrance's,successors, heirs, personal representatives, transferees and
assigns of the respective parties,
In the event that a Building Permit is never obtained to construct the proposed detached
pool house at the request of the OWNER, the CITY shall expllnge this Covenant from the
record title of the PROPERTY
If either party is reqllired to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable
attorneys' fees, from the other party The CITY may assign to per ns i acted by the
