COVENANT REGARDING REAL PROPERTY
Gregory A. Hermanson and Marcy E. Hermanson, Trustees, or SlIccessor Trustees, of the
Hermanson Family Trust dated August 27, 2003 ("OWNER" hereinafter), are the owners of real
property commonly known as Assessor's Parcel Number 314-812-07 ("PROPERTY hereinafter),
and more fuliy described as:
Lot 401 of City of Poway, Tract no 4191-5AR, in the City of Poway, County of San
Diego, State of California, According to Map thereof No 12356, filed in the Office of
the County Recorder of San Diego COllnty April 27, 1989
In consideration of the approval of a BlIilding Permit for a detached accessory structure
at 12647 BlItterwood Court by the City of Poway ("CITY" hereinafter), OWNER hereby agrees
that the detached accessory structure shali never be rented or leased as a separate lInit, no
complete kitchen facilities shali be instalied, and no gas line and/or 220 ampere electrical'service
shall ever be instalied, except for that to be lIsed solely for water heater and heating purposes,
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrance's, sllccessors, heirs, personal representatives, transferees and
assigns of the respective parties,
In the event that a Building Pemlit is never obtained to constrllct the detached accessory
structure at the request of the OWNER, the CITY shall expunge this Covenant from the record title
of the PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shali be entitled to fuli reimbursement of ali costs, including reasonabie attorneys'
fees, from the other party The CITY may assign to persons impacted by the performance of this
Covenant the right to enforce this Covenant against the OWNERS
