COVENANT 'REGARDING REAL PROPERTY -
Helen H, Hickish, a widow ("OWNER" hereinafter), is the owner of real property commonly
known as 16327 Country Day Road ("PROPERTY hereinafter), and more fully described as
LOT 59 OF CITY OF POWAY TRACT NO 4090-R, IN THE CITY OF POWAY,
COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, ACCORDING TO MAP
THEREOF NO 11360 FILED IN THE OFFICE OF THE COUNTY RECORDER OF
SAN DIEGO COUNTY, CALIFORNIA, ON OCTOBER 24,1985,
In consideration of the approval of a Building Permit for a detached 1,945-sqllare-foot
~ccessory structure, consisting of a 1,463-square-foot garage/workshop with a 482-square-foot
second story storage area, by the City of poway ("CITY" hereinafter), OWNER hereby agrees that
the second story. storage area must remain non-habitable space,

This Covenant shall run with the land and be binding upon and inllre to the benefit of the
fllture owners, encllmbrance's, successors, heirs, personal representatives, transferees and
assigns of the respective parties,
In the event that a Building, Permit is never obtained to construct the detached accessory
strllctllreat the reqllest of the OWNER, the CITY shall expunge this Covenant from the record title
of the PROPERTY
If either party is required to incllr costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbllrsement of all costs, inclllding reasonable attorneys'
fees, from the other party The CITY may assign to persons impacted by the performance of this
Covenant the right to enforce this Covenant against the OWNERS,
