COVENANT REGARDING REAL PROPERTY
Andrew Lehrer and Amy Lehrer, husband and wife as community property with right of
survivorship ("OWNERS" hereinafter), are the owners of real property commonly known as
15903 Ranch Hollow Road ("PROPERTY hereinafter), and more fully described as:
Lot 97 of Green Valley Highlands Unit No 3, in the City of Poway, County of San Diego,
State of California, according to map thereof No 8186 filed in the Office of the County Recorder
of San Diego County October 22, 1975.
In consideration of the approval of a Building Permit to construct an addition to an
existing, detached pool house on the referenced property by the City of Poway ("CITY"
hereinafter), OWNER hereby agrees that the detached pool house shall never be rented or
leased as a separate unit, no complete kitchen facilities shall be installed, and no gas line
andlor 220 ampere electrical service shall ever be installed, except in the water heater area' and
then used_solely for.water heater-purposes -. - - -
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrance's, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that a Building Permit is never obtained to construct the proposed detached
pool house at the request of the OWNER, the CITY shall expunge this Covenant from the
record title of the PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable
attorneys' fees, from the other party The CITY may assign to persons impacted by the
performance of this Covenant the right to enforce this Covenant against the OWNERS
