COVENANT REGARDING REAL PROPERTY
Jonathan and Kimberly Weisz ("OWNER" hereinafter) are the owners of real property
commonly known as Assessor's Parcel Number 276~140"11 ("PROPERTY" hereinafter), and more
fully deschbed as:
Parcel 3 of Parcel Map No 14319, in the City of Poway, County of San Diego, State
of California, according ti:>:,map thereof filed in the office ofthe County Recorder of
San Diego County JtJJ1e 18, 1986, under instrument nuri1ber 86-245870
l.nconsideration of the approval by the City of Poway ("CITY" hereinafter), of a Building
PermiUor a.guest house and a detCiched barn at the referenced property, OWNER hereby agrees
that the;guest house and barn shall never be used as, or rented or leased as, a second dwelling
--' uriit;'that"a~stove .or range shall never be installed in_either the guest house or barn, and that,the -
barn shall not be used as a guest house or for human habitation,
, 1'his Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrance's, successors, heirs, personal representatives, transferees and
assigns of the respective parties,
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all cos,ts, including reasonable attorneys'
fees"from the other party The CITY 'may assign tq persons iri1pacted by the performance of this
Covenant the right to enforce this Covenant against the OWNERS
