COVENANT REGARDING REAL PROPERTY
Ambroz Kruty and Margarita Kruty, Husband and wife, PROPERTY OWNERS ("OWNER"
hereinafter), are the owners of real property which is commonly known as APN 323-134-07
("PROPERTY" hereinafter) and more fully described as:
LOT 120 OF PARK POWAY UNIT NO 1 IN THE CITY OF POWAY, COUNTY OF SAN DIEGO,
STATE OF CALIFORNIA, ACCORDING TO THE MAP THEREOF NO 4307 FILED IN THE
OFFICE OF THE COUNTY RECORDER OF SAN DIEGO COUNTY AUGUST 19, 1957
In consideration of the approval by the City of Poway ("CITY" hereinafter) of a Building Permit
to construct a 468-square-foot, detached workshop, with a full bathroom, to an existing singlecfamily
residence located at 13415 Acton Avenue, in the ResidentialSingle"Family 7 (RS-7) zone, OWNER
hereby agrees that no portion of the workshop shall be converted to habital space without prior City
approval. Nor shall the workshop ever be rented or leased as a separate unit, and kitchen facilities
sh'all never be installed, No natural gas connection or 220V electricity is permitted in the workshop or
-- bathroom area.- - - - -- --
This Covenant shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of the
respective parties,
In the event that the Building Permit expires or is rescinded ,by City Council at the request of
the OWNER, CITY shall expunge this Covenant from the record title of the PROPERTY
In the event of litigation to enforce the provisions of this Covenant, the prevailing party shall be
entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party
