COVENANT REGARDING REAL PROPERTY
Whereas Joe W Davies and Doris E, Davies, C6-1rustees ofthe Doris and Joseph Davies
Trust dated September 1, 1992, PROPERTY OWNERS ("OWNER" hereinafter), are the owners of
real property commonly known a,s Assessor's Parcel Number 321-270-83 ("PROPERTY" hereinafter),
and more fully described in Exhibit A.
In consideration of the approval by the City of Poway ("CITY" hereinafter) of a Building
Permit for the construction of an 846-square-foot, attached bonus room/bathroom suite within a
single-family home, OWNER hereby agrees that no portion of the bonus room/bathroom suite area
shall ever be rented or leased as a separate unit, no completekitchen.facilities shall be installed and
no gas line and/or 220 ampere electrical service shall ever be installed,
- This Covenant shall run with the-land and be binding upon and inure to the benefit of the
future.owners, encumbrancers, succes-sors, heirs, personal representatives, transferees and assigns
of the respective parties.
In the event of litigation to enforce.the provisions of this Coyenant, the prevailing party shall be
entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party ~
