NO 3973, FILED IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO
COUNTY, OCTOBER 1, 1958
In consideration of the approval by the City of Poway ("CITY" hereinafter) of a Building Permit
,involving the construction of a 560-square-foot, second-floor storage only mezzanine over the service
area within a commercial building, OWNER hereby agrees that no portion of the referenced storage
only mezzanine shall ever be improved and used for anything other than storage.
This Covenant shall run with'the land and be binding upon and inure to the benefit of the future
owners, encumbrancers, successors, heirs, personal represeniatives, transferees and assigns of the

In the event of litigation to enforce the provisions of this Covenant, the prevailing party shall
