COVENANT'REGARDING REAL PROPERTY .--
Jae Kyung Kim and Yu Jung Kim, Joint Tenants, PROPERTY OWNERS ("OWNER"
hereinafter), are the owners of real property which is commonly known as Assessor's Parcel
Number 314-802-07 ("PROPERTY" hereinafter), and morefu11rdescribed as
LOT 239 OF CITY OF POWAY TRACT NO 4191_3BR, IN THE CITY OF POWAY,
COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, ACCORDING TO. MAP THEREOF
NO 12082, FILED IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO
COUNTY, MAY 7,1988,
In consideration of the approval of a Minor Development Review Application (MORA)
05-58, to construct a single-story room addition that includes a guest unit on the referenced
property by the City of Poway ("GITY" hereinafter), OWNER hereby agrees that the guest unit
shi:!1I never be rented or leased as a separate unit, no kitchen facilities shall be installed, and no
gas line 'and/or 220 amperes electhcal"serVice shan-ever beCinstalled. -. -
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that MORA 05-58 expires or is rescinded by City Council at the request of
the OWNER, CITY shall expunge this Covenant from the record title of the PROPERTY
In the event of litigation to enforce the provisions of this Covenant, the prevailing party
shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the
other party
