AUGUST 14, 1997
The August 14, 1997 meeting, adjourned from the August 12, 1997 regular meeting
of the City Council of the City of Poway, was called to order at 6:03 p.m., by Deputy Mayor
Rexford at the City Council Chambers, 13325 Civic Center Drive, Poway, California.

Deputy Mayor Rexford explained the procedure for Public Oral Communications. There
was no one present wishing to speak.

PRE-DEVELOPMENT CONFERENCE
KIES/ICARUS LANE/POMERADO ROAD
City Manager Bowersox explained the process for a pre-development conference. It is an
opportunity for a potential applicant to have some informal discussion with the City Council
prior to spending money on application fees. No decisions are made.
Eric Kies, 12327 Icarus Lane, stated both of this parents had died in the past year and left
the family their RS-3 property located on the west side of Pomerado Road, between Ted
Williams Parkway and Icarus Lane. Twin Peaks Plaza is across Pomerado Road and the

proposed Palomar College site is across Ted Williams Parkway. The family is looking at
a change to RA or RC for assisted care living facility.
Councilmember Emery asked what zones allow assisted care living. Director of Planning
Services Wright-Quastler stated they are allowed in RA or RC with a Conditional Use
Permit.
Following discussion, Council concurred they would consider a rezone if it also had a
specific plan.
ITEM 2 (701-04)
ADULT BUSINESS ORDINANCE
City Attorney Eckis and Assistant City Attorney Sabine presented a draft Comprehensive
Adult Business Ordinance. The City Council has adopted a moratorium on adult uses in
response to litigation filed against the City of Lemon Grove challenging, among other
things, the validity of that City's general prohibition against public nudity. They have
prepared an ordinance intended as a comprehensive revision of the existing adult
entertainment use regulations, and distributed several secondary effect studies.
Secondary effects are negative impacts from the adult uses. The significant changes from
the existing ordinance include increasing the distance requirement between residential
uses and adult entertainment uses from 200 to 500 feet; and requiring a license for the
operation of an adult entertainment use based on an extensive predetermined set of
performance standards instead of a conditional use permit. The license is not discretionary,
would be issued by the City Manager if all criteria are met, and renewed annually. The
zone allowing adult uses would be changed from the Automotive/General Commercial
Zone to the South Poway Commercial land use area which provides sufficient alternative
sites for the uses as required under the United States Constitution.
During Council discussion, staffwas requested to tailor the ordinance to omit the two South
Poway commercial sites on Pomerado Road from the allowed sites, if possible, and
concurred for staff to bring it back for adoption at a public hearing in September.
ITEM 4 (1110-01)
POMERADO ROAD IMPROVEMENT PROGRAM
Staff report by Director of Engineering Services Weston. Staff has prepared a preliminary
cost estimate for Pomerado Road improvements, from Poway Road to Ted Williams
Parkway, for discussion. The total cost is estimated to be $6.85 million. Much of the west
side of the road needs to be widened and the installation of curb, gutter, sidewalk, sound

walls, storm drain inlets, and landscaping are required, along with a 3" asphalt overlay on
the currently developed portions. They have divided the project into segments in order to
facilitate prioritizing.
Several residents were present to speak in favor of proceeding with the project:
Diane Etchings, 14057 Halper Road, cited the noise impacts.
Gerald Schimke, 14211 Halper Road, stated he would give up 8 feet of his property
in order to install a sound wall.

City Manager Bowersox spoke about the current status of funding. Although there is
currently no funding available, Council will need to prioritize segments for future budgeting
purposes.
ITEM 3 (1110-01)
SCRIPPS POWAY PARKWAY DEDICATION
City Manager Bowersox stated the Scripps Poway Parkway eastern extension will be
completed in October. Staff is requesting direction on the type of dedication celebration
to organize. Council concurred that a community-wide celebration on a Saturday would
be appropriate for this accomplishment.
Gil Olson, 13409 Midland Road, asked why the project is taking so long. Director of
Engineering Services Weston stated the contractor has done a superb job and is well
within his contract period.

GOALS & OBJECTIVES
Due to the lateness of the hour, Deputy Mayor Rexford suggested this item be continued
to the September 11 workshop. Councilmember Goldby requested they be formatted in
a matrix to make it easier to prioritize.
