ORDERING THE SUMMARY VACATION OF AN

IRREVOCABLE OFFER TO DEDICATE
REAL PROPERTY (VAC 06"02) ONM6NTEVISTA ROAD
WHEREAS, an Irrevoca~le Offer to Dedicate Real Property to the City of Poway
was rec;orded on the property located at 12708 Monte Vista Road through Grant Deed
85c109297 for the purpose ora temporary vehicular turnaround area, and
WI;lEREAS, the City Council of the City of Poway desires to summarily vacate
the Irrevocable Offer to Dedicate Real Property in accorpance with the procedures
providedih Chapter 4, Part 3, Division 9 of the Streets and Highways Code of the State
of California, commencing atSectioii 8300; and
WHEREAS, Monte Vista Road terminates in a cul-de"sac within the public right-
of-way that replaces the need fora temporary vehicLilarturnaround area, and
WHEREAS, accep!ance,bfthe Irrevocable Offer to:Dedicate Real Property would
result inan excess of public right~of-way of a street not required for street purposes,
NOW, THEREFORE, BE IT RESOLVED by the City'Council of the City of Poway
as follows:
1, This summary vacation is made under the I?rbvisions of Chapter4, Part 3,
Division 9 of the Streets and Highways Code ofthe State of California.
2, T;he City Cqunc;i1 'hereby finds that acceptance of the Irrevocable Offer to
Dedicate Real Pr6p~rtywould result in an ex_cess of public right-of-way,of
a street not required for street purposes (Section 8334 (a)).
3 The City Council hereby declares that the Irrevocable Offer to Dedicate
Real Property recorded under GrantDeed 85-109297 is hereby vacated.
4 The Oity Clerk of the City of Poway i~ hert;!by qirected to cause a certified
copy ofthis Resolution to be reC6rdedin tneoffice of the Re"corder of San
Diego County in accordance with the provisions of Section 8336 of the
Street and Highways Code of the State:of Galifornia.
