COVENANT REGARDING REAL PROPERTY
Whereas James R. Brown and Shirley G. Brown, Co-Trustees of The Brown Living Trust
dated August 31, 1999, PROPERTY OWNERS ("OWNERS" hereinafter), are the owners of real
property commonly known as Assessor's Parcel Number 275-554-06 ("PROPERTY"
hereinafter), and more fully described as:
LOT 23 OF SUMMERFIELD ESTATES UNIT NUMBER 1, IN THE COUNTY OF
SAN DIEGO, STATE OF CALIFORNIA, ACCORDING TO MAP THEREOF
NUMBER 7420, FILED IN THE OFFICE OF THE COUNTY RECORDER OF SAN' .-
DiEGO COUNTY ON SEPTEMBER 6,1972.
.In cOf1sideration of the approval by the City of poway ("CITY" hereinafter) of Minor
_ Development Review Application- (MDRA) 05C54, involving an. 853-square-footguest unit,

OWNERS hereby agree that no portion of the guest unit shall ever be rented or leased as a
separate unit, complete kitchen. facilities shall not be installed, and no gas line and/or 220
ampere electrical service shall ever be installed.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and'
assigns of the respective parties.
In the event of litigation to enforce the provisions of this Covenant, the prevailing party
shail be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the
other party
