COVENANT REGARDING REAL PROPERTY
. Charles D Marciniak .and Susan L Marciniak, Husband and Wife as Joint Tenants
("OWNER" hereinafter), are the owners of re'al property commonly. Known as Assessor's Parcel
Number 321-280.10 ("PROPERTY" hereinafter), and morefully'described as
Lot 10 ,of Danrena, in the' City cif Poway, County of.San Diego; State of California,
according to Map thereof' No. '5660, filed in the office of the County Recorder of San
Diego County, December 8: 1965
In consideration of the approval of a Building Permit .to. c08struct a 1, 185-squarecfoot,
,detached garage iivith storage area' and bathroom on the referen<<ed property by the City of
poway ("CiTY" hereinafter), OWNER hereby agrees that the ,detached garage shall never be
used as living space, rented.o(leased,as a separate unit; no complete,kitchen facilities shall be
~instaii5'd:,..'arl(tno'gas'iine and/or~220';amp'ere-electficai-serviceshall everbe'installed, except tor
that to be .used solely forthewater heater.
This Covenant shall run with the land and be binding upon and 'inure to the benefit of the
future owners, encumbrances, successors, heirs, personal repfesentatives, transferees and
a:;;signsof the respective parties.
Iii the eVent that a Building Permit is never obtained to construct the proposed detached
garage, at the re,quest of the OWNER" the CITY shall expunge this Covenant from the record
title of the PROPERTY .
If ,either party is required to incur costs to enforce. the provisions of this Covenant, the
prevaiilhg party' shall be entitle-dto full reimbursement of all costs, including reasonable
attorneys' fees, from the other' party The CITY may assign to persons impacted by the
performance of this Covenant 'the right'tCl,enforce this Covenant against the OWNERS' .
