COVENANT REGARDING REAL PROPERTY
Whereas James F McAlexander and Shirley B McAlexander, PROPERTY OWNERS
("OWNER" hereinafter) are the owners of real property commonly known as Assessor's Parcel Number
314-690-25 ("PROPERTY" hereinafter), and more fully described as.
Lot 1 0 of City of Poway Tract No 02'03; in the City of Po way, County of San Diego,
State of California, according to map thereof No 14767, filed in the office of the county
recorder of San Diego County, April 6, 2004
In consideration of the-approval by the City of Poway{'CiTY" hereinafter) of Minor Development
Review Application 05-27, involving the,construction of a single'family home having an approximate
3,1 O-square-foot guest suite, OWNER hereby agrees that no portion onhe guest suite area shall ever
be rented or leased as a separate'unit, no complete kitchen facilities shall be installed, and no gas line
and/or220 ampere electrical service shall ever be installed
This Covenant shall run with'theland.and be binding upon and inure to,the benefit of the future
owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the event that Minor Development Review Application 05-27 expires or is rescinded by the
City Council, and Building Permits are never obtained to construct the proposed guest suite, CITY shall,
at the request of OWNER, expunge this'Covenant from the record title of the PROPERTY
Inthe event of litigation.to enforce the provisions of this Covenant, the prevailing party shall be
entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party
