hereinafter), are the owners of real property commonly known as Assessor's Parcel Number
278-240-29 ("PROPERTY" hereinafter), addressed as 15275 Eastvale Road, Poway, CA and

PARCEL 2 OF PARCEL-MAP NO 18038, IN THE CITY OFPOWAY, COUNTY OF
SAN DIEGO, STATE OF CALIfORNIA, ACCORDING TO MAP THEREOF FILED IN
THEOFFICE OF THE COUNTY RECORDER OF SAN DIEGO COUNTY, MAY 29,
1998
In consideration of the approval by the City of Poway ("CITY" hereinafter) of Minor
Development Review Application 03-42 involving construction of a single-family home that
includes an attached guest uniflocated in the basement, OWNER hereby agrees that no'portion
of the guest unit shall ever be rented or leased as a separate unit, complete kitchen facilities
shall not be installed, and no gas line and/or 220 ampere electrical service shall ever be
installed.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event of litigation to enforce the provisions of this Covenant, the prevailing party
shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the
other party
