COVENANT REGARDING REAL PROPERTY
William J Egan and Margaret A.. Egan, as Trustees of the Egan Revocable Family Trust
dated December 11, 1996 C;'OWNERS'!hereinafter), are thEl. owners of real property commonly
known as Assessor's Parcel Number 275-370-12 ("PROPERTY" hereinafter), and more fully
described as:
Lot 69 .of Valle Estates Unit No.2, in the City of Poway, Cou[lty of San Diego, State of
California, according to map thereof No. 4894, filed inthe Office of the County Recorder of
San Diego County, January 16,1962.

In consideration of the approval of a Building Permit to construct and remodel a 704-
square-foot, detached guest house on the referenced prop.erty by .the City of P6way ("CITY"
hereinafter), OWNER hereby agrees .that the detached gu'est house shall never be rented or
lea~'-edas a separate unit, no.complete-kitchen facilities shall-be installed, and no gas -line and/or
220 ampere electrical service shall ever be installed, except for that to be used solely for water
heater and heating purposes.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, iransferees and
assigns of the,respective parties.
In the event that a Building Permit is never obtained to construct the proposed detached

guest house at the request of the OWNER, the CITY shall expunge this Covenant from the record
title.of the PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys'
fees, from the other party The CITY may assign to persons impacted by the performance of this
Covenant the right to enforce this'Covenantagainst.the OWNERS.
