In consideration of the approval of a building permit to construct a 335-square-foot attached guest house (MORA 04-48) on the referE!riced property by the City of Poway ("CITY" hereinafter), OWNERS hereby'agree that the detached guest house shall never be rented or leased i"s a separate unit, no kitchen facilities shall be installed, and no gas lineand/or 220 amperes electrical service shall ever be installed. This Ccivenantshall run with the land and be binding upon and inure to the benefit of the future owners, encumbrance's, successors, heirs, personal representatives, transferees and assigns .of the respective parties. In the event that building permits are never obtained to construct the proposed detached guest house at the request of the OWNERS, the CITY shall expunge this Covenant from the record title of' the PROPERTY If either party is required to incur costs to enforce the provisions of this Covenant, the prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys~ fees, from the other party The CITY may assign to persons impacted by the performance of this Covenant the right to enforce this Covenant against the OWNER.
