described as:

California, according to 'the rTlClP 'thereof no. 10432, filed in the office of the County
Recorder of San Diego County, July 15, 1982.
In consideration of theappfoval of a Building Permit for a detached accessory structure,
including a 775'square'foot gilnige and a 750-square-foot guest.house orl'the referenced p'foperty
by/the City of poway ("CITY" here,inafter), OWNER hereby <,lgrees\thal the guest house area shall
never be rented, or leased as a separate unit, no complete kitchen facilities shall be installed, and
no:gas tine and/or 220 ampere ele<<tricalservice shall ever be !nst?lll~,d"except for thaUo \:JEl used
solely for water heater and heating purposes, Furthermore, the OWNER hereby agrees that no
part ofthe 775-squafe'foot garage'area shall ever be converted'to living space.
This Covenant shall run with the land and be binding u'pon and inure to the benefit of the
future owners, encumbrance's, successors, heirs, personal representatives, transferees and

assigns of the respective parties.
In thl;l event that a Building Permit is, never obtained to construct the detached accessory
structure aUlle requestofthe'OWNER, the CITY shall expunge.,this Covenant from the record title
of the PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing 'party shall be erititled to full reimbursement of all costs, including reasonable attorneys'
