CC 1997 11-04 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING NOVEMBER 4, 1997 The November 4, 1997, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Higginson at the Community Center, 13094 Bowron Road, Poway, California. Ratification of Warrant Register for period of October 13-17, 1997.(401-10) 7. Denial of Claims against the City: A) James Stone, B) Eisa Whalley(704-13) Approval of City's Investment Report for period ending September 30, 1997. (408-01) o Adoption of Resolution No. 97-091 entitled, "A Resolution of the City of Poway, California Authorizing the Submittal of an Application to the California Integrated Waste Management Board for a Local Government Used Oil Opportunity Grant, and Authorizing the City of Vista to Act as Lead Agency in Executing all Necessary Applications, Contracts, Payment Requests, Agreements and Amendments." (401-30) 10. Adoption of Planning Resolution No. P-97-61 entitled, "A Resolution of the City of Poway, California Approving Minor Development Review Amendment 97-63 (Hillside/Ridgeline) Assessor's Parcel Number 321-110-45"; for a 4,6~~, square foot house with a 1,328 square foot garage, and a 1,345 square foot guest house with a 504 sq. ft. garage on 14.9 acres at 15545 Westview Road, west of Mina de Oro Rd. (off Highway 67); Andrew Pavelchek/Sally Wixted, applicants. (203-10) 10.1 Approval of Change Order in amount not to exceed $181,592.00, and Acceptance of Improvements for the Lester J. Berglund Water Treatment Plant, C. E. Wylie Construction (#1718). (602-01 #1058) 10.2 Approval of Bid for Purchase of Fumishings and Equipment for the Poway Sheriff's Substation in the amount of $122,393.74 of Supplemental Law Enforcement Services (SLESF) Funds to Contract Interiors (Haworth, Inc. and California Communities Purchasing Program). (602-01 #1228) Motion carried 4-0 with Councilmember Goldby absent. ITEM 1 (1204-05) WATER AND SEWER RATE STRUCTURES Mayor Higginson opened the public hearing. Introduction by City Manager Bowersox. 6216 Page 3 - CITY OF POWAY - November 4, 1997 In August of 1996, the City contracted with The Keese Company to conduct a water and wastewater rate study. The purpose was to review the current rate structures from the standpoint of customer equity, consistency with City policy objectives and cost of services. The Keese Company performed an in-depth analysis of the current rate structure, customer classes and their historic water use, and operation and maintenance costs for the two utilities. Further, they evaluated a variety of rate structures to help determine which would be most appropriate for achieving the policy objectives. Preliminary findings were presented at a Council workshop on September 11, 1997 after which notices were sent to all of the City's water and sewer customers. The notice gave a brief explanation of the proposed new rate structures and announced the November 4 public hearing. Staff report by Director of Administrative Services Stewart. The bimonthly water service charge is recommended to be revised to improve equity between meter sizes based on the hydraulic capacity of the customer's water meter. Approximately 50 residential customers have water meters larger than 3/4 inch. Many are left over from old groves and are now larger than the capacity needed for the property. If the property meets the criteria for the smaller 3/4 inch meter, they will be billed at the lower meter size for the water service charge. The water commodity rate remains a uniform rate structure at $1.663 per unity for FY 1997-98. The current fiat rate sewer charge per equivalent dwelling unit (EDU) would be replaced by a new structure which would include two components: A seven-tier commodity charge for residential, single family users based on 85% of the lowest water use during the prior year's winter months, which includes a bi- monthly sewer service charge of $7.03. o A bimonthly service charge to recover all costs associated with customer service and a portion of the fixed costs associated with maintaining the capacity of the City's sewer system. A variable commodity charge for multi-family and commercial users. The rate charged will depend upon the customer class based upon the estimated sewage strength of the users. This recommended rate structure will result in lower bills for all single family customers using less than 20 HCF of water bimonthly. Single family customers with a higher water use will see increased water/sewer bills. Multi-family and mobile home customers will see sizable decreases in their combined billings. Non-residential, commercial customers will see varying combined rate increases or decreases based on their actual annual water use and their sewage strength. 6217 Page 4 - CITY OF POWAY - November 4, 1997 Options available to water and sewer customers to try and lower their bills include: Installation of a separate landscape meter for those who feel a greater percentage of their water is being used for landscaping. The meter would be installed at the customer's expense. o A water efficiency audit which identifies ways that water use can be reduced such as installation of Iow-flow toilets, repairs of leaks, changes to irrigation systems or schedules. All of these commercial accounts will be contacted in eady November so they will have an opportunity to take these steps in advance of the implementation of the new rate structure. Additionally, water customers with septic tanks and no access to the City's sewage system will not receive sewer charges; The increase in water service charges based upon hydraulic capacity of the meter size will impact the City's residential customers with 1" or larger meters. There are approximately 460 1" residential meters which are required because of fire sprinkler systems, insufficient water pressure, and higher water demands due to large lot size. Staff would not recommend reducing the meter size below 1". The charges for 1" meters will increase by approximately $13.14 bimonthly. The consultant took into consideration the fact that Poway has a large number of large lots which use irrigation water. Speaking in opposition of staff recommendation: Joe Harper, 1555 Oakstand Rd. Speaking in favor of staff recommendation: Robert Waite, 12910 Slack St. (pay for what he uses) Ron Enos, 16342 Martincoit representing Green Valley Civic Association inquired whether the City would pay for meter size reductions Mayor Higginson declared a recess at 8:20 p.m. Council reconvened at 8:25 p.m. with all members present except Councilmember Goldby. Following discussion, motion by Councilmember Emery, seconded by Mayor Hlgginson to close the public hearing, direct staff to review accounts with 1" and 1-1/2" meters, and adopt Resolution No. 97-092 entitled "A Resolution of the City Council of the City of Poway, California Establishing Water Rates for Fiscal Year 1997-1998 and Rescinding Resolution No. 96-074" and Resolution No. 97-093 entitled "A Resolution of the City Council of the City of Poway, California Amending the Schedule of Sewer Service Charges and Establishing Sewer Service Charges for Fiscal Year 1997-1998 and Rescinding Resolution No. 96-075." Motion carried 4-0 with Councilmember Goldby absent. The new rates will be effective with the first full billing cycle after January 1, 1998. ITEM 3 (203-08) ENVIRONMENTAL ASSESSMENT CONDITIONAL USE PERMIT 97-07 APPLICANT: MCMAHON/OLIPHANT Mayor Higginson opened the public headng. Staff report by City Manager Bowersox. This is a request to approve warehousing and distribution of pre-packaged hazardous materials and chemicals at the northwest corner of the intersection of Crosthwaite Circle and the Page 6 - CITY OF POWAY - November 4, 1997 13600 Block of Stowe Dr. Staff recommends approval. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councilmember Rexford, to close the public hearing, issue a Negative Declaration with Mitigation Measures and adopt Planning Resolution No. P-97-62 entitled, "A Resolution of the City Council of the City of Poway, California Approving Conditional Use Permit 97-07 Assessor's Parcel Number 317-280-52." Motion carried 4-0 with Councilmember Goldby absent. ITEM 5 (1504-10) CITIZEN'S OPTION FOR PUBLIC SAFETY Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. Included in the State of Califomia budget for 1997-98 was the $100 million Citizen's Option for Public Safety (COPS) program which is funded by the State's General Fund. This program will provide the City of Poway with $105,799.58 for the current year which will be used for equipment for the new Poway Sheriff's Station. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councilmember Cafagna, to close the public hearing and approve the expenditure. Motion carried 4-0 with Councilmember Goldby absent. CITY ATTORNEY ITEMS 12. City Attorney Eckis requested closed sessions to discuss existing litigation under Government Code Section 54956.9(a) in the cases of: A) Poway Land v. City of Poway, San Diego Superior Court case No. 701895 and B) Poway Royal Mobile Home Owners Association v. City of Poway, San Diego Superior Court Case No. 682581. CLOSED SESSION Mayor Higginson called for a closed session at 9:10 p.m. as requested by the City Attorney. 6220 Page 7 - CITY OF POWAY - November 4, 1997 CALL TO ORDER AND ADJOURNMENT Mayor Higginson called the meeting back to order at 9:49 p.m. with all Councilmembers present. He stated the Council had instructed the City Attorney and no report is required. Mayor Higginson adjourned the meeting at 9:50 p.m. on motion by Councilmember Cafagna and seconded by Councilmember Emery. Lorl A.
