Knothe, ("OWNERS" hereinafter), are the owners of real property commonly known as Assessor's Parcel Number 275-062-02 ("PROPERTY 'hereinafter), and more fUlly described as: Parcel 46 as shown and designated on Record of Survey No. 4253, filed April 10, 1957, said Survey being a portion of the Eastone-half of Section. 25, Township 13 South, Range 2 West, and the West one-half of Section 30, Township 13 South, Range 1 West, together with an easement for road purposes to be used in common with others over that certain strip of land shown on said survey as Sagewood Drive. In consideration of the approval of a Building Permit to convert a 441-square-foot garage into living space on the referenced property by the City of Poway ("CITY" hereinafter), OWNERS hereby agree that the living space' created as a result of this garage conversion shall never be -, -' rented-or-Ieased as a-separate unit~ no kitchen facilitiesshallbe-iilstalled-and' no new'gas'line and/or 220 amperes electrical service shall ever be installed. This Covenant shall run with the land and be binding upon and inure to the benefit of the future owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of the respective parties. In the event that a Building Permit is never obtained to construct the proposed room addition at the request of the OWNERS, the CITY shall expunge this Covenant from the record title of the PROPERTY If either party is required to incur costs to enforce the provisions of this Covenant, the prevailing party shall be entitled to. fl!!1 reimbursemeni of'allcosts, including reasonable attorneys' fees, from the other party The CITY may assign to persons impacted by the performance of this Covenant the right to enforce this Covenantagainst OWNERS OWNERS.
