COVENANT REGARDING REAL PROPERl'Y
Edward A. Walby and Vicki Walby, husband and wife, as joint tenants, PROPERTY
OWNERS ("OWNER" hereinafter), are the owners of real property described as
THAT PORTION OF SECTIONS OF 25-ANQ 36 IN TOWNSHIP 13 SOUTH, RAJ'iGE 2
WEST SAN BERNARDINO BASE AND MERIDIAN, ACCORDING TO UNITED STATES
GOVERNMENT SURVEY THEREOF, SHOWN AS PARCEL 12 OF THE RECORD OF 84;94
SURVEY MAP NO 3897, FILED IN THE OFFICE OF THE COUNTY RECORDEROF'SAN
DIEGO, APRIL 10, 1956,
and which is commonly known as Assessor's Parcel Number 275-262-03 ("PROPERTY"
hereinafter).
In consideration of the approval by the City of Poway ("CITY" hereinafter) of Minor

Development Review Application (MDRA) 03-78, a request to add 3,191 square feet, including a
first story living area, to a developed single-family 1 1"acre property, located at 16166 Martincoit
Road, within the Rural Residential C zone, OWNER hereby' agrees that no portion of the living
area (game and media roorns) shall ever be rented or leased as a separate unit, and kitChen
facilities shall never be .installed. No natural gas connection or 220V electricity is permitted in this
area.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that MDRA03-78 expires or is rescinded by City Council at the request of the
OWNER, CITY shall expunge this ,Covenant from the record title of the PROPERTY
In the:event of litigatiori,toenforcethe provisions 6fthis:.Covenant, the prevailing party shall
be entitled to full reimbursement of all costs, including,reasonable attorneys' fees, from the other
pa rty
