Faaborg Family Trust, PRQPERTY OWNER ("OWNER" hereinafter), is the owner of real
property which is commonly known as Assessor's Parcel Number 321-270-21 ("PROPERTY"
hereinafter), and more fully described.as
THE NORTH ONE+iALF OF THE NORTHEAST QUARTER OF THE
SOUTHEAST QUARTER 9F THE NORTHEAST ~UARTER OF SECTION 8,
TOWNSHIP 14 soum, RANGE 1 WEST, SAN BERNflRDINO BASE AND
MERIDIAN, IN THE COUNTY OF SAN DIEGO,STATE OF CALIFORNIA,
ACCORDING TO UNITED STATES GOVERNMENT SURVEY
In consideration of the approval .of a Building Permit to construct a 2,903'square,foot,
two-story barn on the referenced property by the City of Poway ("CITY" hereinafter), OWNER
hereby agrees that the barn is non'habitable space and that il,shall never be rented or leased
as a separate unit, no kitchen facilities shall be installed, and no gas line and/or 220 amperes I
electrical service shall ever be installed.
This Covenant shall .run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances,successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event of litigation to enforce the provisions of this Covenant, the prevailing party
shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the
other party
