December 16, 1970
In consideration of the approval of a Building Permit to construd a 228.-square-foot
addition on the referenced property byihe City of Poway ("CITY'" hereinafter), OWNERS hereby
agree that ,the room addition shallneller be rented or leased as a separate unit, n\>. kitchen
- .- - facilities shall-be installed and: no gas line and/or 220 amperes. electricalser:vice shall. ever be
installed.
This. Covenant shall runwith'ihe land and be binding upon and inure to the benefit-of the
future owners, encumbrancers, successors, heirs, personal. representatives, transferees and
assigns of the respective parties.
In the event that a BUjldilJg' P~rmit is never obtained to .constructthe proposed room
addition at the request of the OWNERS, the CITY shall expunge this Covenant from the record
title of the PROPERTY
If'either party is required to incur costs to enforce the provisions of this Covemant: the
prel/ailirig party shall be entitled to full reimbursement of all costs, including reasonable
attorneys' fees, from the other party The CITY may assign to persons impacted by the
