APN 321-243-04 2005-0189776 I COVENANT REGARDING REAL PROPERTY Roy W Pelkey and Terri Pelkey. husband and wife as joint tenants ("OWNERS" hereinafter), are the owners of real property commonly known as Assessor's Parcel Number 321-243-04 ("PROPERTY hereinafter), and more fully described as: Lot 60 of County of San Diego Tract 3864, in the City of Poway, County of San Diego, State of California, according to Map thereof No. 9766, filed in the Office of the County Recorder of San Diego County, August 20,1980. In consideration of the approval of a Building Permit to construct a 499"square,foot, detached guest house on the referenced property by the City of poway ("CITY" hereinafter), OWNER hereby agrees that the detached guest house shall never be rented or leased as a separate unit, no complete kitchen facilities shall be installed, and no gas line and/or 220 ampere electrical service shall ever be installed, except in the water heater area and then used solely for water heater purposes. This Covenant shall run with the land and be binding upon and inure to the benefit-of the future owners, encumbrance:s, successors, heirs, personal representatives, transferees and assigns of the respective parties. In the event that a Building Permit is never obtained to construct the proposed detached guest house at the request of the OWNER, the CITY shall expunge this Covenant from the record title of the PROPERTY If either party is required to incur costs to enforce the provisions of this Covenant, the prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party The CITY may assign to persons impacted by the performance of this Covenant the right to enforce this Covenant against the OWNERS.
